SYNOPSIS
Prohibits sale of powdered caffeine.

An Act concerning the sale of powdered caffeine and supplementing Title 2C of the New Jersey Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. A person who sells, offers for sale, or gives to any person powdered caffeine is a petty disorderly person. A person who commits a second or subsequent offense under this section is a disorderly person.
For the purposes of this section, "powdered caffeine" means a product containing 100 percent caffeine in powdered or crystalline form and does not include: (1) caffeine pills, tablets or caplets containing 200 milligrams or less of caffeine per dose, or (2) coffee, tea or any other substance meant for human consumption containing caffeine combined with other ingredients or components.
2. This act shall take effect immediately.
STATEMENT
This bill prohibits the sale of powdered caffeine in this State. Under the provisions of the bill, a person who sells, offers for sale, or gives powdered caffeine to any person is a petty disorderly person. A person who commits a second or subsequent offense is a disorderly person. A petty disorderly person's offense is punishable by a fine of up to $500, a term of imprisonment not to exceed 30 days, or both. A disorderly person's offense is punishable by a fine of up to $1,000, a term of imprisonment not to exceed six months, or both.
The bill defines "powdered caffeine" as a product containing 100 percent caffeine in powdered or crystalline form. The definition specifically excludes caffeine pills, tablets or caplets containing 200 milligrams or less of caffeine per dose, as well as coffee, tea or any other substance meant for human consumption that contains some amount of caffeine combined with other ingredients or components.
