SYNOPSIS
Requires DOE provide report to regional school districts every 10 years regarding different tax levy apportionment methodologies.

An Act concerning tax levy apportionment in regional school districts and supplementing chapter 13 of Title 18A of the New Jersey Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. Within 90 days following the effective date of P.L. , c. (C. ) (pending before the Legislature as this bill), and within 30 days following each subsequent official promulgation of the federal census, the Commissioner of Education shall provide an apportionment report to the board of education of a regional school district. For each regional school district, the apportionment report shall state how the annual or special appropriations for the regional school district would be apportioned among the constituent municipalities of the regional school district if the apportionment were to be determined on the basis of:
a. the portion of each municipality's equalized valuation allocated to the regional school district;
b. the proportional number of pupils enrolled from each municipality on the 15th day of October of the prebudget year in the same manner as would apply if each municipality comprised separate school districts;
c. a combination of apportionment based upon equalized valuations accounting for 50% of the apportionment and pupil enrollments accounting for 50% of the apportionment; and
d. if applicable, the combination of apportionment based upon equalized valuations and pupil enrollments pursuant to subsection c. of N.J.S.18A:13-23 used by the regional school district at the time that the apportionment report is prepared.
2. This act shall take effect immediately.
STATEMENT
This bill requires that the Commissioner of Education provide an apportionment report to the board of education of each regional school district. The first such report would be sent to the board within 90 days following the bill's effective date, and each subsequent report would be transmitted within 30 days following the official promulgation of the federal census. The apportionment report would provide information on how the general fund tax levy would be apportioned among the constituent municipalities of the regional school district if the apportionment were to be determined based on: 1) equalized valuations, 2) pupil enrollments, 3) a combination of equalized valuations and pupil enrollments in which both account for 50 percent of the apportionment, and 4) any other combination of equalized valuations and pupil enrollments used by the regional school district at the time that the apportionment report is prepared.
