     Provides that parent of nonpublic school pupil who lives more than 20 miles from school will receive payment toward transportation costs.

An Act concerning certain nonpublic school pupil transportation costs and supplementing chapter 39 of Title 18A of the New Jersey Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  Notwithstanding the provisions of N.J.S.18A:39-1 or any other section of law to the contrary, in the case of a nonpublic school pupil who:

     (1)   resides in a school district that provides transportation for public school pupils; and

     (2)   attends a nonpublic school, not operated for profit in whole or in part, located within the State more than 20 miles from the residence of the pupil,

the parent or guardian of the pupil shall be eligible to receive a payment from the school district toward the cost of the transportation to the nonpublic school.  The amount of the payment shall be calculated as follows:

 

     TP = ((SD - 20)/20) x TCPP

 

where

 

     SD is the number of miles from the pupil's residence to the nonpublic school; and

 

     TCPP is the maximum amount of nonpublic school transportation costs per pupil determined pursuant to section 2 of P.L.1981, c.57 (C.18A:39-1a).

     b.    The costs incurred by a school district to make the payments required pursuant to subsection a. of this section shall be borne by the State.

 

     2.    This act shall take effect immediately and shall first be applicable to the 2015-2016 school year.

 

 

STATEMENT

 

     Under current law, a pupil who attends a nonpublic school that is located within the State and is no more than 20 miles from the pupil's residence is eligible to receive transportation services, or in certain circumstances, an aid-in-lieu-of transportation payment. The amount of the aid-in-lieu-of transportation payment equals the maximum amount of nonpublic school transportation costs per pupil which is established annually.  If the nonpublic school is located more than 20 miles from the pupil's residence, then the pupil is not eligible for either transportation or a payment.

     This bill provides support for the transportation costs of a nonpublic school pupil who attends a school located within the State that is more than 20 miles from the pupil's residence.  Under the reimbursement formula, the pupil's parent or guardian would receive a payment from the district in an amount equal to the percent by which the number of transported miles exceeds 20 miles multiplied by the maximum amount of nonpublic transportation costs per pupil.

     The bill specifies that the State will bear the cost of the payments required under the bill.
