An Act concerning campaign contributions to candidates for election to the office of member of a school board and supplementing chapter 16 of Title 18A of the New Jersey Statutes and chapter 34 of Title 19 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    If the cumulative total of all contributions of money or other thing of value paid or made by a person, the person's spouse, and any dependent child, parent or sibling residing in the person's household to a candidate for election to the office of member of the board of education of a Type II school district, or to the campaign treasurer, deputy campaign treasurer, candidate committee or joint candidates committee of such a candidate, exceeds in the aggregate $100 per election, that person shall be ineligible to be appointed or to serve as an administrator of that school district for a period of two years following the date on which the last such contribution by that person or such member of the person's family with respect to that election is paid or made.

     For the purposes of this section, "administrator" shall have the meaning prescribed for that term by section 3 of P.L.1991, c.393 (C.18A:12-23), and "candidate", "candidate committee" and "joint candidates committee" shall have the meanings respectively prescribed for those terms by section 3 of P.L.1973, c.83 (C.19:44A-3).

 

     2.    The cumulative total of all contributions of money or other thing of value paid or made by the administrator of a Type II school district and the spouse and any dependent child, parent or sibling of such an administrator residing in the administrator's household to a candidate for election to the office of member of the board of education of that district, or to the campaign treasurer, deputy campaign treasurer, candidate committee or joint candidates committee of such a candidate, shall not exceed in the aggregate $100 per election.  No candidate for election to the office of member of the board of education of a Type II school district, the candidate's campaign treasurer, deputy campaign treasurer, candidate committee or joint candidates committee shall knowingly accept from an administrator of that school district, or the spouse or any dependent child, parent or sibling of such an administrator residing in the administrator's household, cumulative contributions of money or other thing of value which exceed in the aggregate $100 per election.

     For the purposes of this section, "administrator" shall have the meaning prescribed for that term by section 3 of P.L.1991, c.393 (C.18A:12-23), and "candidate", "candidate committee" and "joint candidates committee" shall have the meanings respectively prescribed for those terms by section 3 of P.L.1973, c.83 (C.19:44A-3).

 

     3.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill prohibits any person holding an  administrative position in a Type II school district from making campaign contributions, directly or through a family member, to a candidate for election to the office of member of the board of education of that district which exceed in the aggregate $100 per election.  The bill also provides that if a person, or the family member of a person, makes campaign contributions to a candidate for election to the office of member of the board of education of a Type II school district which exceed in the aggregate $100, the person shall be ineligible to be appointed to an administrative position in that school district for a period of two years following the date on which the last such contribution with respect to that election is paid or made.
