An Act concerning satellite-based monitoring of certain convicted sex offenders and supplementing P.L.1994, c.133.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. a. A person required to register pursuant to section 2 of P.L.1994, c.133 (C.2C:7-2) who is homeless or without domicile or whose home or domicile cannot be verified under the program established pursuant to subsection b. of this section, shall be subject to constant monitoring through a satellite-based time correlated or continuous tracking of their geographic location using global positioning system (GPS) devices.
b. The Attorney General shall establish and maintain a program to constantly monitor, through a satellite-based time correlated or continuous tracking, persons required to register pursuant to section 2 of P.L.1994, c.133 (C.2C:7-2), if such persons are homeless or without domicile or whose home or domicile cannot be verified. The program shall monitor such persons' geographic location using global positioning system (GPS) devices.
c. A person who is monitored under the program established pursuant to this act and who knowingly fails to comply with its requirements or knowingly tampers with tracking equipment with the intent of rendering such equipment ineffective is guilty of a crime of the fourth degree.
2. This act shall take effect on the first day of the 10th month following enactment provided that the Attorney General may take such anticipatory action in advance thereof as shall be necessary for the implementation of this act.
STATEMENT
This bill provides for the satellite-based monitoring of homeless person who are required to register because of prior sex offences under Megan's Law. Under the act, sex offenders are subject to continuous 24-hour per day monitoring by global positioning system (GPS) devices.
