SYNOPSIS
Exempts senior citizens, disabled persons, and veterans from E-ZPass account monthly service charge.

An Act exempting senior citizens, disabled persons, and veterans from the monthly service charge for electronic toll collection system accounts.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. a. The New Jersey Turnpike Authority shall not charge, collect, or otherwise receive a monthly service charge or fee for an electronic toll collection system account from any account holder who is:
(1) a senior citizen 65 years of age or older;
(2) a person with a disability; or
(3) a veteran.
b. As used in this section:
"Person with a disability" means a person who by reason of any permanent, medically determinable physical, or mental impairment is incapable of engaging in normal physical or mental activities, and includes, but is not limited to, any person determined disabled pursuant to the federal Social Security Act or any other governmental retirement or benefits program that uses substantially the same criteria for determining eligibility.
"Veteran" means a person who has been honorably discharged or released under honorable circumstances from the Armed Forces of the United States or a reserve component thereof.
c. The Authority shall promulgate, in accordance with the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.), regulations establishing the types of evidence that may be used to qualify persons for the exemption provided by this section and other such rules and regulations as may be necessary to effectuate the purposes of this section.

3. This act shall take effect immediately.
STATEMENT
This bill would exempt senior citizens 65 years of age or older, disabled persons, and veterans from being charged a monthly service fee on their E-ZPass accounts. Disabled persons use E-ZPass transponders for their own modified motor vehicles or to pay tolls when being driven by others.
