Requires MVC to license certain mobile auto body shops.

An Act concerning mobile auto body shops and amending P.L.1983, c.360
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. Section 2 of P.L.1983, c.360 (C.39:13-2) is amended to read as follows:
2. a. The commission shall establish a system for the licensure of auto body repair facilities and persons. This system may provide for licenses based upon the type or types of motor vehicles repaired by the facility and the equipment required for repair of the vehicles. At a minimum, the commission shall provide for the following:
(1) a full service auto body repair facility license, the qualifications for which are established under section 7 of this amendatory and supplementary act[, and];
(2) an automobile dealer sublet license, the qualifications for which are established under section 8 of this amendatory and supplementary act; and
(3) a mobile painter's auto body shop license, which would license a person to conduct painting repairs on vehicles, provided that issuance of such a license to a person may not be conditioned on any of the following: (a) ownership or occupation of real property; (b) acquisition of any rights to real property or permits to use certain real property, or documents issued by zoning authorities, which would require the existence of real property; or (c) the acquisition or use of equipment that can only be transported using a vehicle with a gross vehicle weight rating of more than 8,000 pounds.
All facilities or persons licensed pursuant to this section may hold themselves out to the public as licensed auto body repair facilities or persons.
b. No person may engage in the business of an auto body repair facility unless it is licensed by the commission. An auto body repair facility shall be licensed by the commission upon submission and approval of an application and payment of a reasonable application fee sufficient to cover the cost of implementing the provisions of this act and to be prescribed by the commission. The commission may require biennial renewal of applications for licensure and may stagger the renewal dates and adjust the application fees accordingly.

2. This act shall take effect immediately.
STATEMENT
This bill would provide for the issuance of a mobile painter's auto body shop license that would license persons who conduct painting repairs on vehicles. Issuance of the license by the Motor Vehicle Commission may not be conditioned on the ownership or occupation of real property, or the ownership of equipment that can only be transported using a vehicle with a gross vehicle weight rating of more than 8,000 pounds.
This bill would require the Motor Vehicle Commission to issue licenses to those persons who conduct paint repairs on vehicles and who also operate mobile auto body shops, if the commission determines that the law requires them to be licensed.
