SYNOPSIS

     Prohibits law enforcement agency from conducting certain checkpoints and inspections limited only to motorcycles.

An Act concerning certain motor vehicle stops and supplementing Title 39 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    1[No] A1 law enforcement agency shall 1not1 conduct a roadside checkpoint or other systematic inspection of vehicles 1[on the highways] along any public road, street, or highway1 of this State 1[that is limited to a certain type of vehicle.

     The provisions of this section shall not apply to roadside checkpoint or inspection of commercial vehicles as defined in section 3 of P.L.1990, c.103 (C.39:3-10.11)] if the roadside checkpoint or systematic inspection is established for the sole purpose of inspecting motorcycles1.

     This section shall not be construed to restrict or limit 1in any capacity1 any other type of checkpoint 1, inspection,1 or roadblock 1[which is lawful] conducted by a law enforcement agency for legitimate public safety reasons1.

 

     2.    This act shall take effect immediately.
