     Requires installation of automatic rain sensors on lawn sprinklers.

An Act concerning the installation of automatic rain sensor devices, and amending and supplementing P.L.2000, c.107.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.  Section 1 of P.L.2000, c.107 (C.52:27D-123.13) is amended to read as follows:

     1.  a.  An automatic lawn sprinkler system installed after [the effective date of P.L.2000, c.107 (C.52:27D-123.13)] September 8, 2000 shall be equipped with an automatic rain sensor device or switch that will override the irrigation cycle of the automatic lawn sprinkler system when adequate rainfall has occurred.

     b.  No later than 24 months after the effective date of P.L.    , c.    (C.            )(pending before the Legislature as this bill), every automatic lawn sprinkler system installed prior to September 8, 2000 on any real property, in the case of single-family or multi-family residential premises, apartment building or garden apartment complex, or commercial or industrial property, shall be equipped with an automatic rain sensor device or switch that will override the irrigation cycle of the automatic lawn sprinkler system when adequate rainfall has occurred.

     2.    (New section)  An automatic lawn sprinkler system installed 24 months after the effective date of P.L.    , c.     (C.            )(pending before the Legislature as this bill) on any real property, in the case of single-family or multi-family residential premises, apartment building or garden apartment complex, or commercial or industrial property, shall be equipped with an automatic rain sensor device or switch that will override the irrigation cycle of the automatic lawn sprinkler system when adequate rainfall has occurred.

 

     3.  (New section)  In any case where a change of occupancy of any real property subject to the requirements of subsection a. of section 1 of P.L.2000, c.107 (C.52:27D-123.13) is subject to a municipal ordinance requiring the issuance of a certificate of occupancy, certificate of inspection or other documentary certification of compliance with laws and regulations relating to safety, healthfulness and upkeep of the premises, no such certificate shall issue until the municipal officer or agency responsible for its issuance has determined that the lawn sprinkler system installed upon the real property is equipped with an automatic rain sensor device or switch that will override the irrigation cycle of the automatic lawn sprinkler system when adequate rainfall has occurred as required by subsection a. of section 1 of P.L.2000, c.107 (C.52:27D-123.13).

     5.  This act shall take effect immediately.

 

 

STATEMENT

 

     The provisions of P.L.2000, c.107 (C.52:27D-123.13) require the installation of an automatic rain sensor device or switch that will override the irrigation cycle of the automatic lawn sprinkler system when adequate rainfall has occurred.  Any automatic lawn sprinkler system installed after September 8, 2000 must be equipped with such a device.

     This bill requires that every existing automatic lawn sprinkler system installed prior to September 8, 2000 on any real property, in the case of single-family or multi-family residential premises, apartment building or garden apartment complex, or commercial or industrial property, must be retrofitted with an automatic rain sensor device within 24 months of the bill's effective date.

     The bill requires municipal certification that the lawn sprinkler system installed upon such real property is equipped with an automatic rain sensor device or switch as a condition of transfer of the property.
