An Act concerning screening for adrenoleukodystrophy in newborn infants and supplementing Title 26 of the Revised Statutes

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  All infants born in this State shall be tested for adrenoleukodystrophy (ALD) beginning six months following the occurrence of all of the following:

     (1)   the development of a reliable 1[methodology] test or series of tests1 for screening newborns for ALD using dried blood spots1[,]1 and quality assurance testing methodology for 1[the test] ALD testing1;

     (2)   1[the registration with the federal Food and Drug Administration of any reagents necessary for the test;

     (3)]1  the availability 1of quality assurance materials for the ALD test1 from the federal Centers for Disease Control and Prevention 1[of any necessary reagents]1; 1[and]

      (3)  the inclusion of newborn screening for ALD in the Recommended Uniform Screening Panel of the United States Secretary of Health and Human Services' Advisory Committee on Heritable Disorders in Newborns and Children, after the committee's evidence review of newborn screening for ALD;1

     (4) 1[the acquisition by the Department of Health and Senior Services of] the review by the Department of Health of the proposed test; and

     (5)1 the 1acquisition of1 equipment necessary to implement the expanded screening tests 1by the State's Newborn Screening Laboratory.1

     b.    The Department of Health 1[and Senior Services]1 may charge a reasonable fee 1and any reasonable increase in this fee as necessary,1 for the test performed pursuant to this section.  The amount of the fee and the procedures for collecting the fee shall be determined by the Commissioner of Health 1[and Senior Services]1.

 

     2.    This act shall take effect immediately.
