An Act creating the offense of soliciting images of a child for an unlawful purpose and supplementing chapter 24 of Title 2C of the New Jersey Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. a. A person commits a disorderly persons offense if, with unlawful purpose, he solicits a minor or a person who he believes to be a minor to transmit via the Internet any clearly identifiable photographic image of the minor or another minor. "Unlawful purpose" includes but is not limited to any criminal offense involving endangering the welfare of children.
b. Prosecution under the provisions of this act shall not be a bar to prosecution under N.J.S.2C:24-4 or any other provision of law.
2. This act shall take effect immediately.
STATEMENT
This bill creates the offense of soliciting a minor with unlawful purpose to transmit, including via the Internet, any photographic image of the minor or another minor. The offense is classified as a disorderly persons offense punishable by up to six months imprisonment, a fine of up to $1,000, or both. This offense targets conduct which may not culminate in the publication of offensive or pornographic images of a minor, but is nonetheless undertaken with unlawful purpose.
