An Act increasing representation for Hispanic communities and amending P.L.1983, c.567.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. Section 6 of P.L.1983, c.567 (C.40:10C-1) is amended to read as follows:
6. A municipality or a county with an Hispanic population of 10% or more, according to the latest federal decennial census, may by resolution establish a municipal or county Hispanic advisory commission, as appropriate, which shall advise the municipal and county governing bodies on matters concerning the needs of the Hispanic community and the impact of local legislation on the Hispanic community in the municipality or the county. A municipal or county Hispanic advisory commission so established shall consist of at least five members, to be appointed by majority vote of the governing body of the municipality or county. The members of the commission shall be residents of the municipality or county and shall represent the Hispanic community within the municipality or county. The members shall serve for a term of three years from the date of their appointment and until their successors are appointed and qualified; except that of the first appointments [hereunder: one shall be for a term of one year, two for two years, and two for three years] or appointments increasing the membership of the committee, the resolution shall designate staggered terms for the members appointed to the committee. Vacancies resulting from causes other than by expiration of term shall be filled for the unexpired term only and shall be filled in the same manner as the original appointments were made. The municipal or county advisory commission shall periodically report to and meet with the commission. The governing body of the municipality or county may provide for the employment of officers and employees as may be necessary or desirable for the proper functioning of the municipal or county Hispanic advisory commission.

2. This act shall take effect immediately.
STATEMENT
This bill authorizes municipal
and county Hispanic advisory commissions to increase the number of sitting
members. Under
current law, membership on a Hispanic advisory commission is limited to five
members. This bill would permit more extensive representation on a Hispanic
advisory board by modifying the statutory language of concerning prescribed
membership.
The existing language of N.J.S.A.40:10C-1 provides that a municipal or county Hispanic Advisory Commission is limited to five members. This bill would modify the law to allow a municipal or county commission to be comprised of more than five members appointed by the governing body of a municipality or county. Increasing the membership of an advisory commission would provide an opportunity for a more diverse and comprehensive representation of the Hispanic community's views when the commission advises local governing bodies.
