       AN ACT to amend the administrative code of the  city  of  New  York,  in
         relation to non-preferential building access
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Title 26 of the administrative code of the city of New York
    2  is amended by adding a new chapter 12 to read as follows:
    3                                 CHAPTER 12
    4                             EQUAL BUILDING USE
    5    S 26-1200 NON-PREFERENTIAL BUILDING ACCESS. NOTWITHSTANDING  ANY  LAW,
    6  RULE OR REGULATION TO THE CONTRARY, NO OCCUPANT OF AN AFFORDABLE HOUSING
    7  UNIT,  AS DEFINED BY SECTION 23-911 OF THE ZONING RESOLUTION OF THE CITY
    8  OF NEW YORK, LOCATED IN A BUILDING OWNED BY DEVELOPERS CURRENTLY RECEIV-
    9  ING FINANCIAL ASSISTANCE OR SUBSIDIES FROM THE  STATE  SHALL  BE  DENIED
   10  ACCESS TO AN ENTRY TO THE BUILDING IN WHICH SUCH UNIT IS LOCATED THAT IS
   11  MADE  AVAILABLE FOR USE BY ANY OCCUPANT IN A NON-AFFORDABLE HOUSING UNIT
   12  NOT UNIQUE TO SUCH OCCUPANT.
   13    S 2. This act shall take effect on the thirtieth day  after  it  shall
   14  have become a law.
