        AN  ACT  to  amend  the  insurance  law, in relation to mandatory health
          insurance coverage for certified registered nurse anesthetists provid-
          ing anesthesia services
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
     1    Section  1.  Subsection  (i)  of  section 3216 of the insurance law is
     2  amended by adding a new paragraph 34 to read as follows:
     3    (34) Every policy which provides for coverage for anesthesia  services
     4  shall  include coverage for anesthesia services provided by an independ-
     5  ently employed certified registered nurse anesthetist. The term  "certi-
     6  fied  registered nurse anesthetist" as used in this paragraph shall mean
     7  a person who has satisfactorily completed  educational  preparation  for
     8  the  practice  of nurse anesthesia in a program accredited by a national
     9  accrediting body recognized by the department of health or determined by
    10  the department of health to be  the  equivalent  and  who  is  currently
    11  certified  by a national certifying body recognized by the department of
    12  health.
    13    § 2. Subsection (l) of section 3221 of the insurance law is amended by
    14  adding a new paragraph 20 to read as follows:
    15    (20) Every policy which provides for coverage for anesthesia  services
    16  shall  include coverage for anesthesia services provided by an independ-
    17  ently employed certified registered nurse anesthetist. The term  "certi-
    18  fied  registered nurse anesthetist" as used in this paragraph shall mean
    19  a person who has satisfactorily completed  educational  preparation  for
    20  the  practice  of nurse anesthesia in a program accredited by a national
    21  accrediting body recognized by the department of health or determined by
    22  the department of health to be  the  equivalent  and  who  is  currently
    23  certified  by a national certifying body recognized by the department of
    24  health.

     1    § 3. Section 4303 of the insurance law is  amended  by  adding  a  new
     2  subsection (oo) to read as follows:
     3    (oo)  Every policy which provides for coverage for anesthesia services
     4  shall include coverage for anesthesia services provided by an  independ-
     5  ently  employed certified registered nurse anesthetist. The term "certi-
     6  fied registered nurse anesthetist" as used in this subsection shall mean
     7  a person who has satisfactorily completed  educational  preparation  for
     8  the  practice  of nurse anesthesia in a program accredited by a national
     9  accrediting body recognized by the department of health or determined by
    10  the department of health to be  the  equivalent  and  who  is  currently
    11  certified  by a national certifying body recognized by the department of
    12  health.
    13    § 4. This act shall take effect on the ninetieth day  after  it  shall
    14  have  become  a  law  and  shall apply to policies and contracts issued,
    15  renewed, modified, altered or amended on or after such effective date.
