       AN ACT to amend the public health law, in relation to requiring at least
         two qualified individuals to be present supervising a public or school
         pool when instructional activity is taking place
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Section 225 of the public health law is amended by adding a
    2  new subdivision 5-d to read as follows:
    3    5-D. THE SANITARY CODE SHALL PROVIDE THAT  WHEN  INSTRUCTIONAL  ACTIV-
    4  ITIES ARE TAKING PLACE AT A PUBLIC OR SCHOOL SWIMMING POOL, AT LEAST TWO
    5  POOL STAFF MEMBERS MEETING AT LEAST SUPERVISION LEVEL III SHALL BE PRES-
    6  ENT.
    7    S 2. This act shall take effect immediately.
