STATE OF NEW YORK ________________________________________________________________________ 2851 2023-2024 Regular Sessions IN ASSEMBLY January 27, 2023 ___________ Introduced by M. of A. PEOPLES-STOKES -- read once and referred to the Committee on Education AN ACT prohibiting the approval of a charter school application when such school would operate within the Buffalo city school district; and providing for the repeal of such provisions upon expiration thereof The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Notwithstanding any provision of law, rule or regulation to 2 the contrary, commencing on July 1, 2023, no application to establish a 3 charter school submitted pursuant to section 2851 of the education law 4 shall be approved by any charter entity if such proposed charter school 5 would operate within the Buffalo city school district. Furthermore, a 6 charter that has been surrendered, revoked or terminated within the 7 Buffalo city school district on or after July 1, 2023, including a char- 8 ter that has not been renewed by action of its charter entity, shall not 9 be reissued within the Buffalo city school district. 10 § 2. This act shall take effect immediately and shall expire and be 11 deemed repealed June 30, 2026. EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted.
