STATE OF NEW YORK ________________________________________________________________________ 3250 2021-2022 Regular Sessions IN ASSEMBLY January 22, 2021 ___________ Introduced by M. of A. DILAN -- read once and referred to the Committee on Health AN ACT to amend the public health law, in relation to prohibiting certain pre-K programs from requiring the influenza vaccine for chil- dren entering such programs The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 2164 of the public health law is amended by adding 2 a new subdivision 9 to read as follows: 3 9. Notwithstanding any provision of law to the contrary, no person in 4 parental relation to a child in this state entering or having entered a 5 child care, head start, nursery, 3-K or pre-K program or a comparable 6 program for children age six months through fifty-nine months, shall be 7 required to have administered to such child an immunization against 8 influenza. 9 § 2.
