        Introduced by M. of A. CUSICK -- read once and referred to the Committee
          on  Tourism,  Parks, Arts and Sports Development -- recommitted to the
          Committee on Tourism, Parks, Arts and Sports Development in accordance
          with Assembly Rule 3, sec. 2 -- committee  discharged,  bill  amended,
          ordered reprinted as amended and recommitted to said committee
        AN  ACT  to  amend the arts and cultural affairs law, in relation to the
          resale of tickets issued to generate revenue for charitable purposes
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
     1    Section  1.  The  arts and cultural affairs law is amended by adding a
     2  new section 25.06 to read as follows:
     3    § 25.06. Resale of tickets issued to generate revenue  for  charitable
     4  purposes.  1.  It shall be unlawful for any person, firm, or corporation
     5  to resell or offer to resell any ticket or other evidence  of  right  of
     6  entry  to any place of entertainment for more than the established price
     7  if the ticket was initially offered to the public at no charge or if the
     8  event generates ticket sale revenue dedicated to a charity.
     9    2. For the purposes of this section, an event will be deemed to gener-
    10  ate ticket sale revenue dedicated to a charity if at least  ten  percent
    11  of  the original sale or auction price of the ticket is designated for a
    12  charitable purpose, as defined by section one hundred two  of  the  not-
    13  for-profit corporation law.
    14    §  2. This act shall take effect on the forty-fifth day after it shall
    15  have become a law; provided, however, that section 25.06 of the arts and
    16  cultural affairs law, as added by section one of this act, shall survive
    17  the expiration and reversion of article 25 of such law  as  provided  in
    18  section 4 of chapter 704 of the laws of 1991, as amended.
