LAVALLE -- read twice and ordered print- ed, and when printed to be committed to the Committee on Environmental Conservation IN ASSEMBLY -- Introduced by M. of A. THIELE -- read once and referred to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to the taking of sharks; and providing for the repeal of such provisions upon expiration thereof THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Section 13-0338 of the environmental conservation law is 2 amended by adding a new subdivision 5 to read as follows: 3 5. SHARKS, EXCLUDING SPINY DOGFISH, SHALL NOT BE TAKEN FOR COMMERCIAL 4 OR RECREATIONAL PURPOSES BY BAITED HOOKING EXCEPT WITH THE USE OF 5 NON-STAINLESS STEEL NON-OFFSET CIRCLE HOOKS. IN ADDITION, NO PERSON 6 SHALL CONDUCT, SPONSOR OR PARTICIPATE IN ANY SHARK TOURNAMENT UNLESS 7 SAID TOURNAMENT'S RULES AND REGULATIONS REQUIRE THE EXCLUSIVE USE OF 8 NON-STAINLESS STEEL NON-OFFSET CIRCLE HOOKS. 9 S 2. This act shall take effect immediately and shall expire and be 10 deemed repealed December 31, 2015.
