Bill Title: Directs the commissioner of health to establish a medicaid reimbursement rate of nine hundred sixty dollars per treatment for outpatient hyperbaric therapy, which rate shall be applied retroactively for all hyperbaric therapy treatment provided since 1996 by hospitals outside of New York city in a county of more than one million three hundred thousand persons as determined by the two thousand decennial federal census.

       AN ACT  to  amend  the  public  health  law,  in  relation  to  medicaid
         reimbursement for outpatient hyperbaric therapy
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Section 2807 of the public health law is amended by  adding
    2  a new subdivision 22 to read as follows:
    3    22.  NOTWITHSTANDING ANY OTHER PROVISION OF LAW, RULE OR REGULATION TO
    4  THE CONTRARY, THE COMMISSIONER SHALL ESTABLISH A MEDICAID  REIMBURSEMENT
    5  RATE  OF  NINE HUNDRED SIXTY DOLLARS PER TREATMENT FOR OUTPATIENT HYPER-
    6  BARIC THERAPY AND SUCH RATE  SHALL  BE  APPLIED  RETROACTIVELY  FOR  ALL
    7  HYPERBARIC  THERAPY TREATMENT PROVIDED SINCE NINETEEN HUNDRED NINETY-SIX
    8  BY HOSPITALS OUTSIDE OF THE CITY OF NEW YORK IN A COUNTY  OF  MORE  THAN
    9  ONE  MILLION  THREE  HUNDRED  THOUSAND  PERSONS AS DETERMINED BY THE TWO
   10  THOUSAND DECENNIAL FEDERAL CENSUS.
   11    S 2. This act shall take effect immediately.
