       AN ACT to amend the vehicle and traffic law, in relation to  authorizing
         "right on red" in Richmond county
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Paragraph 2 of subdivision (d) of section 1111 of the vehi-
    2  cle and traffic law, as separately amended by chapters 230  and  420  of
    3  the  laws of 1980 and subparagraph c as added by chapter 317 of the laws
    4  of 1997, is amended to read as follows:
    5    2.  Except in [a city having a population of one million or more]  THE
    6  COUNTIES OF NEW YORK, KINGS, QUEENS AND BRONX, unless a sign is in place
    7  prohibiting such turn:
    8    a.  Traffic  facing  a steady circular red signal may cautiously enter
    9  the intersection to make a right turn  after  stopping  as  required  by
   10  paragraph  one of this subdivision, except that right turning traffic is
   11  not required to stop when a steady right green arrow signal is shown  at
   12  the  same time. Such traffic shall yield the right-of-way to pedestrians
   13  within a marked or unmarked crosswalk at the intersection and  to  other
   14  traffic lawfully using the intersection;
   15    b. Traffic, while on a one-way roadway, facing a steady red signal may
   16  cautiously  enter  the  intersection  to make a left turn onto a one-way
   17  roadway after stopping as required by paragraph one of this subdivision.
   18  Such traffic shall yield the right-of-way to pedestrians within a marked
   19  or unmarked crosswalk at the intersection and to other traffic  lawfully
   20  using the intersection.
   21    c. On or after the effective date of this subparagraph, the sign which
   22  prohibits  such  turn  shall  be  prominently  displayed  from all newly
   23  installed traffic signals where possible.
   24    Notwithstanding any other provision of law, any city  having  a  popu-
   25  lation  of  one  million  or more, is hereby authorized and empowered to

    1  adopt a local law authorizing subparagraph a or b of this  paragraph  to
    2  be applicable within [such city] THE COUNTIES OF NEW YORK, KINGS, QUEENS
    3  AND  BRONX.  Upon  the adoption of such local law the exception provided
    4  herein for [a city having a population of one million or more] THE COUN-
    5  TIES  OF NEW YORK, KINGS, QUEENS AND BRONX shall no longer be applicable
    6  within such [city] COUNTIES.
    7    S 2. This act shall  take  effect  on  the  first  of  September  next
    8  succeeding the date on which it shall have become a law.
