       AN ACT in relation to allowing certain employees of the Vanderbilt Muse-
         um and Planetarium to receive additional  service  credit  from  their
         prior service in the employ of Suffolk county
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Notwithstanding any inconsistent provision of law,  Stanley
    2  B.    Coffield,  former employee of the Suffolk County Vanderbilt Museum
    3  and Planetarium in Centerport, Long Island, and a retired member of  the
    4  New  York  State and Local Employees' Retirement System, who for reasons
    5  not ascribable to his own negligence, was disenrolled from the New  York
    6  State  and Local Employees' Retirement System retroactive to February 1,
    7  1973, without notice from such retirement system or his employer,  shall
    8  be  eligible to receive service credit, for any time not already credit-
    9  ed, in such system for the period from November 1, 1972  through  August
   10  1,  1990,  during  which period he was an employee of the Suffolk County
   11  Vanderbilt Museum. Such additional credit shall only be obtained if,  on
   12  or  before  the thirty-first day of December next succeeding the date on
   13  which this act shall have become a law, he files a written request  with
   14  the administrative head of the retirement system seeking to receive such
   15  service credit.
   16    S  2.  Notwithstanding  any  inconsistent  provision  of law, Peter D.
   17  Valerio, former employee of the Suffolk  County  Vanderbilt  Museum  and
   18  Planetarium in Centerport, Long Island, and member of the New York State
   19  and  Local  Employees'  Retirement   System, Reg. No. 1321449-9, who for
   20  reasons not ascribable to his own negligence, was disenrolled  from  the
   21  New  York  State  and  Local Employees' Retirement System retroactive to
   22  February 1, 1973, without notice from  such  retirement  system  or  his
   23  employer,  shall  be  eligible  to  be reinstated to membership with his
   24  original date of membership and tier status and receive service  credit,

    1  for  any  time  not already credited, in such system for the period from

    3  employee of the Suffolk County Vanderbilt Museum. Such additional credit

    9  Levine, former employee of the  Suffolk  County  Vanderbilt  Museum  and
   10  Planetarium in Centerport, Long Island, and member of the New York State
   11  and  Local  Employees'  Retirement  System,  Reg. No. 1176603-7, who for
   12  reasons not ascribable to his own negligence, was disenrolled  from  the
   13  New  York  State  and  Local Employees' Retirement System retroactive to
   14  February 1, 1973, without notice from  such  retirement  system  or  his
   15  employer,  shall  be  eligible  to  be reinstated to membership with his
   16  original date of membership and tier status and receive service  credit,
   17  for  any  time  not already credited, in such system for the period from
   18  November 1, 1972 through August 1, 1990, during which period he  was  an
   19  employee of the Suffolk County Vanderbilt Museum. Such additional credit
   20  shall only be obtained if, on or before the thirty-first day of December
   21  next  succeeding  the date on which this act shall have become a law, he
   22  files a written request with the administrative head of  the  retirement
   23  system seeking to receive such service credit.
   24    S  4.  Notwithstanding  any  inconsistent provision of law, Stephen G.
   25  Moore, former employee of the Suffolk County Vanderbilt Museum and Plan-
   26  etarium in Centerport, Long Island, and member of the New York State and
   27  Local Employees' Retirement System, Reg. No. 1257416-6, who for  reasons
   28  not  ascribable to his own negligence, was disenrolled from the New York
   29  State and Local Employees' Retirement System retroactive to February  1,
   30  1973,  without notice from such retirement system or his employer, shall
   31  be eligible to be reinstated to membership with  his  original  date  of
   32  membership  and tier status and receive service credit, for any time not
   33  already credited, in such system for the period from  November  1,  1972
   34  through  August  1,  1990, during which period he was an employee of the
   35  Suffolk County Vanderbilt Museum. Such additional credit shall  only  be
   36  obtained if, on or before the thirty-first day of December next succeed-
   37  ing the date on which this act shall have become a law, he files a writ-
   38  ten  request with the administrative head of the retirement system seek-
   39  ing to receive such service credit.
   40    S 5. All costs associated with the implementation of the provisions of
   41  this act shall be borne by the  New  York  State  and  Local  Employees'
   42  Retirement  System,  except  any contributions received by the TIAA-CREF
   43  pension fund for the period after August 1, 1990.
   44    S 6. In the event that the individuals named in this act retire  prior
   45  to  the  effective date of this act, such retirement will not effect the
   46  outcome and the member will be deemed to have been restored  to  his  or
   47  her  prior  membership and tier status on the date immediately preceding
   48  the effective date of retirement.
   49    S 7. This act shall take effect immediately.
         FISCAL NOTE.--Pursuant to Legislative Law, Section 50:
         This bill will allow four former employees of Suffolk County's Vander-
       bilt Museum, a non-participating employer in  the  New  York  State  and
       Local  Employees'  Retirement System, to receive tier status and service
       credit for the service they rendered with the museum  from  November  1,
       1972 through August 1, 1990.

         If  this bill is enacted, we anticipate that there will be an increase
       of approximately $2,200 in the annual contributions of the State of  New
       York for the fiscal year ending March 31, 2012.
         In addition to the annual cost above, we anticipate that there will be
       an  immediate past service cost of approximately $925,000, which will be
       shared by the State of New York and all the participating  employers  in
       the New York State and Local Employees' Retirement System.

       during the 2011  Legislative  Session,  is  Fiscal  Note  No.  2011-120,
       prepared  by  the  Actuary  for  the New York State and Local Employees'
       Retirement System.
