STATE OF NEW YORK ________________________________________________________________________ 7223--A 2021-2022 Regular Sessions IN ASSEMBLY April 29, 2021 ___________ Introduced by M. of A. EPSTEIN -- read once and referred to the Commit- tee on Governmental Employees -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the civil service law, in relation to requiring the president of the civil service commission to conduct a study on the employment of persons and veterans with disabilities by the state The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The civil service law is amended by adding a new section 2 59-c to read as follows: 3 § 59-c. State employment of persons and veterans with disabilities 4 study. 1. The president shall conduct a comprehensive study analyzing 5 the effectiveness of sections fifty-five-b and fifty-five-c of this 6 title which deals with the employment of persons and veterans with disa- 7 bilities by the state and prepare and submit an annual report to the 8 speaker of the assembly, the minority leader of the assembly, the tempo- 9 rary president of the senate, the minority leader of the senate and the 10 governor's office of employee relations, and make publicly available on 11 the department's website no later than one year after the effective date 12 of this section, and every year thereafter. 13 2. Such report shall include but not be limited to: 14 (a) the number of persons with a letter of eligibility under sections 15 fifty-five-b and fifty-five-c of this title that have received a civil 16 service appointment; 17 (b) the number of persons at the time of the report who have received 18 a letter of eligibility from the department certifying they are eligible 19 to be appointed in accordance with sections fifty-five-b and 20 fifty-five-c of this title; 21 (c) the number of persons with a physical or mental disability 22 appointed in accordance with sections fifty-five-b and fifty-five-c of 23 this title that have taken a promotional examination including the EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD10474-02-1A. 7223--A 2 1 number of such persons that have taken a promotional examination within 2 the last five years; 3 (d) a determination as to whether the state is underutilizing the 4 provisions of such sections based on such findings from the report; 5 (e) an assessment of whether the state offers any additional programs 6 run by the state with the mission to increase the employment of people 7 with disabilities, including, but not limited to: Adult Career and 8 Continuing Ed Services (ACCES-VR) within the education department and 9 the office for people with developmental disabilities' supported employ- 10 ment services programs; and 11 (f) recommendations based on the findings from the report as to wheth- 12 er the state can take additional action to market or inform the public 13 of state job opportunities for persons and veterans with disabilities 14 and if so, what specific actions should be taken. 15 3. For the purposes of this section, the president may conduct such 16 study in conjunction with any other department, division, board, bureau, 17 commission, agency, or public authority of the state deemed necessary. 18 To the maximum extent feasible, the president shall be authorized to 19 request, receive, and utilize such resources and data of any other 20 department, division, board, bureau, commission, agency, or public 21 authority of the state as he or she may reasonably request to properly 22 carry his or her powers and duties pursuant to this section. 23 4. The president shall promulgate rules and regulations as may be 24 necessary to effectuate the provisions of this section. 25 § 2. This act shall take effect immediately.
