        AN ACT to amend the insurance law, in relation to insurance coverage  of
          in vitro fertilization and other fertility preservation treatments
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1.  Clause  (iii)  of  subparagraph  (C)  of  paragraph  6  of
     2  subsection  (k)  of  section  3221  of  the insurance law, as amended by
     3  section 1 of part L of chapter 57 of the laws of  2019,  is  amended  to
     4  read as follows:
     5    (iii)  Except  as  provided  in [items] clauses (vi) and (vii) of this
     6  subparagraph, coverage shall not be required to  include  the  diagnosis
     7  and  treatment of infertility in connection with: (I) [in vitro fertili-
     8  zation, gamete intrafallopian tube transfers  or  zygote  intrafallopian
     9  tube  transfers;  (II)] the reversal of elective sterilizations; [(III)]
    10  (II) sex change procedures; [(IV)] (III) cloning; or [(V)] (IV)  medical
    11  or surgical services or procedures that are deemed to be experimental in
    12  accordance  with clinical guidelines referenced in [item] clause (iv) of
    13  this subparagraph.
    14    § 2. Subparagraph (C) of paragraph 3 of subsection (s) of section 4303
    15  of the insurance law, as amended by section 2 of part L of chapter 57 of
    16  the laws of 2019, is amended to read as follows:
    17    (C) Except as provided in subparagraphs (F) and (G) of this paragraph,
    18  coverage shall not be required to include the diagnosis and treatment of
    19  infertility in connection with:  (i)  [in  vitro  fertilization,  gamete
    20  intrafallopian  tube  transfers or zygote intrafallopian tube transfers;
    21  (ii)] the reversal of elective sterilizations; [(iii)] (ii)  sex  change
    22  procedures;  [(iv)]  (iii)  cloning;  or  [(v)] (iv) medical or surgical
    23  services or procedures that are deemed to be experimental in  accordance
    24  with  clinical  guidelines  referenced in subparagraph (D) of this para-
    25  graph.
    26    § 3. This act shall take effect on the  same  date  and  in  the  same
    27  manner as part L of chapter 57 of the laws of 2019, takes effect.
