       AN ACT to allow Carol A. Duermeyer to file a request for Tier II  status
         in  the New York state and local employees' retirement system with the
         state comptroller
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  Notwithstanding any inconsistent provisions of law, Carol
    2  A.  Duermeyer, who was a non-teaching employee of  the  Amherst  central
    3  school  district,  located  in Erie county, and a member of the New York
    4  state and local employees' retirement system, who began such  employment
    5  on  January  1,  1976,  may be deemed to have become a member of the New
    6  York state and local employees' retirement system having Tier II  status
    7  on  January  1,  1976  and shall be entitled to every right, benefit and
    8  privilege which would have been available to her with Tier II status if,
    9  on or before the thirty-first day of December next succeeding  the  date
   10  on which this act shall have become a law, she shall file with the state
   11  comptroller a written request to that effect.
   12    S 2. This act shall take effect immediately.
         FISCAL NOTE.--This bill will change the date of membership of Carol A.
       Duermeyer,  who  was  an employee of the Amherst Central School District
       and is now a retiree of the New York State and Local Employees'  Retire-
       ment System, to January 1, 1976, thereby granting her tier 2 status.
         If  this bill is enacted, there will be an immediate past service cost
       of approximately $26,900 which will be shared by the State of  New  York
       and  all  the  participating  employers  of the New York State and Local
       Employees' Retirement System.
         This estimate, dated March 3, 2009 and intended for  use  only  during
       the  2009  Legislative Session, is Fiscal Note No. 2009-168, prepared by
       the Actuary for the New  York  State  and  Local  Employees'  Retirement
       System.
