       AN  ACT to amend the public health law and the elder law, in relation to
         requiring hospitals to provide long-term care contact  information  to
         certain patients
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. The public health law is amended by adding  a  new  section
    2  2803-t to read as follows:
    3    S  2803-T.  LONG-TERM CARE CONTACT INFORMATION. THE COMMISSIONER SHALL
    4  REQUIRE THAT EVERY HOSPITAL SHALL PROVIDE TO EVERY  PATIENT  ANTICIPATED
    5  TO  BE  IN  NEED OF LONG-TERM CARE, CONTACT INFORMATION AT THE TIME SUCH
    6  DETERMINATION IS MADE FOR AT LEAST ONE POINT OF CONTACT IN THE PATIENT'S
    7  COUNTY OF RESIDENCE FOR THE NY CONNECTS:  CHOICES  FOR  LONG  TERM  CARE
    8  PROGRAM ESTABLISHED PURSUANT TO SUBDIVISION EIGHT OF SECTION TWO HUNDRED
    9  THREE  OF THE ELDER LAW, OR IN THE EVENT THAT SUCH POINT OF CONTACT DOES
   10  NOT EXIST IN THE PATIENT'S COUNTY OF RESIDENCE, CONTACT INFORMATION  FOR
   11  THE  AGENCY  ON AGING SERVING THE PATIENT'S COUNTY OF RESIDENCE, AND ANY
   12  OTHER INFORMATION APPROPRIATE TO THE NEEDS AND  CHARACTERISTICS  OF  THE
   13  PATIENT,  INCLUDING BUT NOT LIMITED TO LOCAL INDEPENDENT LIVING CENTERS,
   14  LOCAL DEPARTMENTS OF SOCIAL SERVICES AND LOCAL DEPARTMENTS OF HEALTH.
   15    S 2.  Subdivision 8 of section 203 of  the  elder  law,  as  added  by
   16  section  18  of  part B of chapter 58 of the laws of 2007, is amended to
   17  read as follows:
   18    [8.] 9. The director, in consultation with the commissioner of health,
   19  shall establish a program to be known as the NY  Connects:  Choices  for
   20  Long Term Care. The purpose of this initiative is to provide consistent,
   21  comprehensive,  locally-based  information  and  assistance on long term
   22  care services to consumers, caregivers and families to  help  them  make
   23  educated  choices.  This  program shall provide individuals, caregivers,
   24  and families with  objective  information  and  assistance  about  home,

    1  community-based  and  institutional long term care services. NY Connects
    2  will be available on a voluntary  basis  to  consumers,  caregivers  and
    3  their  families.  There  shall  be  an  on-going  education and outreach
    4  campaign  to  educate the public about long term care services available
    5  in their community and to assist consumers in preparing for  their  long
    6  term  care  needs, INCLUDING BUT NOT LIMITED TO PROVIDING LONG-TERM CARE
    7  CONTACT  INFORMATION  ESTABLISHED  UNDER  SECTION  TWENTY-EIGHT  HUNDRED
    8  THREE-T OF THE PUBLIC HEALTH LAW.
    9    S  3.  This  act shall take effect on the thirtieth day after it shall
   10  have become a law.
