STATE OF NEW YORK ________________________________________________________________________ 7843 2023-2024 Regular Sessions IN ASSEMBLY July 7, 2023 ___________ Introduced by M. of A. KELLES -- read once and referred to the Committee on Libraries and Education Technology AN ACT to amend the education law, in relation to requiring that libraries have policies prohibiting the banning of books in order to receive state aid The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 273 of the education law is amended by adding a new 2 subdivision 12 to read as follows: 3 12. No library or library system shall be eligible for state aid 4 unless such library or library system has included as part of their 5 operating plan or has established policies incorporating the provision 6 of the American Library Association's Library Bill of Rights that indi- 7 cates that materials should not be proscribed or removed because of 8 partisan or doctrinal disapproval or has developed a written statement 9 prohibiting the practice of banning books or other materials within the 10 library or library system and prohibits the practice of banning specific 11 books or resources. 12 § 2.
