MAGNARELLI, GALEF -- read once and referred to the Committee on Local Governments AN ACT to repeal certain provisions of the general municipal law relat- ing to urban renewal agencies; to repeal certain provisions of the general municipal law relating to industrial development agencies; to repeal certain provisions of the public authorities law relating to certain authorities; to repeal article 2-D of the transportation law relating to the Utica transit authority; and to transfer any books, records and remaining rights of any dissolved authority to an iden- tifiable location THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Legislative intent. It is hereby declared to be a substan- 2 tial interest of this state that residents, governments and businesses 3 have certainty in the corporate status and orderly dissolution of public 4 authorities, urban renewal agencies, industrial development agencies, 5 and parking authorities, and that upon dissolution, their enabling stat- 6 utes will be repealed and their books, records and remaining rights, if 7 any, will be transferred to an identifiable location. The welfare of the 8 state necessitates ensuring that the proliferation of moribund public 9 benefit corporations, such as those included in this act found to be 10 defunct by the comptroller, the authorities budget office and the New 11 York state commission on public authority reform, does not continue 12 unchecked. 13 S 2. Title 2 of article 15-B of the general municipal law is REPEALED. 14 S 2-a. Notwithstanding any other provision of law to the contrary, any 15 existing records, property, rights, titles and interest of the Sloats- 16 burg urban renewal agency shall vest in and be possessed by the village 17 of Sloatsburg and its successors or assigns. 18 S 3. Title 6 of article 15-B of the general municipal law, as amended 19 by chapter 209 of the laws of 1976, is REPEALED. 20 S 3-a. Notwithstanding any other provision of law to the contrary, any 21 existing records, property, rights, titles and interest of the Beacon EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. Notwithstanding any other provision of law to the contrary, any 6 existing records, property, rights, titles and interest of the Norwich 7 urban renewal agency shall vest in and be possessed by the city of 8 Norwich and its successors or assigns. 9 S 5. Title 7 of article 15-B of the general municipal law, as added by 16 chapter 914 of the laws of 1964, is REPEALED. 17 S 6-a. Notwithstanding any other provision of law to the contrary, any 18 existing records, property, rights, titles and interest of the Peekskill 19 community development agency shall vest in and be possessed by the city 20 of Peekskill and its successor or assigns. 21 S 7. Title 8 of article 15-B of the general municipal law, as added by 22 chapter 266 of the laws of 1964, is REPEALED. 23 S 7-a. Notwithstanding any other provision of law to the contrary, any 24 existing records, property, rights, titles and interest of the Mount 25 Kisco urban renewal agency shall vest in and be possessed by the village 26 of Mount Kisco and its successors or assigns. 27 S 8. Title 8 of article 15-B of the general municipal law, as added by 28 chapter 603 of the laws of 1964, is REPEALED. 29 S 8-a. Notwithstanding any other provision of law to the contrary, any 30 existing records, property, rights, titles and interest of the Island 31 Park urban renewal agency shall vest in and be possessed by the village 32 of Island Park and its successors or assigns. 33 S 9. Title 9 of article 15-B of the general municipal law is REPEALED. 34 S 9-a. Title 10 of article 15-B of the general municipal law, as added 39 by chapter 83 of the laws of 1964, is REPEALED. 40 S 10-a. Notwithstanding any other provision of law to the contrary, 41 any existing records, property, rights, titles and interest of the 42 Hornell urban renewal agency shall vest in and be possessed by the city 43 of Hornell and its successors or assigns. 44 S 11. Title 10 of article 15-B of the general municipal law, as added 45 by chapter 266 of the laws of 1964, is REPEALED. 46 S 11-a. Notwithstanding any other provision of law to the contrary, 47 any existing records, property, rights, titles and interest of the Wash- 48 ingtonville urban renewal agency shall vest in and be possessed by the 49 village of Washingtonville and its successors or assigns. 50 S 12. Title 11 of article 15-B of the general municipal law is 51 REPEALED. 52 S 12-a. Notwithstanding any other provision of law to the contrary, 53 any existing records, property, rights, titles and interest of the 54 Mamaroneck urban renewal agency shall vest in and be possessed by the 55 town of Mamaroneck and its successors or assigns. Notwithstanding any other provision of law to the contrary, 10 any existing records, property, rights, titles and interest of the 11 Plattsburgh urban renewal agency shall vest in and be possessed by the 12 city of Plattsburgh and its successors or assigns. 13 S 15. Title 18 of article 15-B of the general municipal law is 14 REPEALED. 15 S 15-a. Notwithstanding any other provision of law to the contrary, 16 any existing records, property, rights, titles and interest of the 17 Woodridge urban renewal agency shall vest in and be possessed by the 18 village of Woodridge and its successors or assigns. 19 S 16. Notwithstanding any other provision of law to the contrary, 19 any existing rights, property, assets and funds of the Long Island job 20 development authority shall pass to and be vested jointly in the coun- 21 ties of Nassau and Suffolk and their successors or assigns. 22 S 116. Title 10 of article 8 of the public authorities law is 23 REPEALED. 24 S 116-a. Notwithstanding any other provision of law to the contrary, 25 any existing records, property, rights, titles and interest and all 26 obligations and liabilities of the historic Rome development authority 27 shall vest in and be possessed by the city of Rome and its successors or 28 assigns. 29 S 117. Title 13-A of article 8 of the public authorities law is 30 REPEALED. 31 S 117-a. Notwithstanding any other provision of law to the contrary, 32 any existing records, property, rights, titles and interest and all 33 obligations and liabilities of the multi-town solid waste management 34 authority shall vest in and be possessed jointly by the town of Babylon 35 and the town of Huntington and their successors or assigns. 36 S 118. Title 13-D of article 8 of the public authorities law, as added 37 by chapter 930 of the laws of 1983, is REPEALED. 38 S 118-a. Notwithstanding any other provision of law to the contrary, 39 any existing records, property, rights, titles and interest and all 40 obligations and liabilities of the Broome county resource recovery agen- 41 cy shall vest in and be possessed by Broome county and its successors or 42 assigns. 43 S 119. Title 13-K of article 8 of the public authorities law is 44 REPEALED. 45 S 119-a. Notwithstanding any other provision of law to the contrary, 46 any existing records, property, rights, titles and interest and all 47 obligations and liabilities of the county of Essex solid waste manage- 48 ment authority shall vest in and be possessed by Essex county and its 49 successors or assigns. 50 S 120. Title 13-J of article 8 of the public authorities law is 51 REPEALED. 52 S 120-a. Notwithstanding any other provision of law to the contrary, 53 any existing records, property, rights, titles and interest and all 54 obligations and liabilities of the town of Brookhaven resource recovery 55 agency shall vest in and be possessed by the town of Brookhaven and its 56 successors or assigns. Title 14-A of article 8 of the public authorities law is 9 REPEALED. 10 S 122-a. Notwithstanding any other provision of law to the contrary, 11 any existing records, property, rights, titles and interest and all 12 obligations and liabilities of the city of Peekskill civic center 13 authority shall vest in and be possessed by the city of Peekskill and 14 its successors or assigns. 15 S 123. Title 28-C of article 8 of the public authorities law is 16 REPEALED. 17 S 123-a. Notwithstanding any other provision of law to the contrary, 18 any existing records, property, rights, titles and interest and all 19 obligations and liabilities of the county of Chautauqua sports, recre- 20 ation and cultural authority shall vest in and be possessed by Chautau- 21 qua county and its successors or assigns. 22 S 124. Article 2-D of the transportation law is REPEALED. 23 S 124-a. Notwithstanding any other provision of law to the contrary, 24 any minutes, annual reports, property, rights, liabilities, obligations 25 or records of the Utica transit authority, including but not limited to 26 those required by the federal government or any of its agencies, the 27 state comptroller, or the commissioner of transportation, shall vest in 28 and be possessed by the central New York regional transportation author- 29 ity and its successors or assigns. 30 S 125. Title 70 of article 15-B of the general municipal law is 31 REPEALED. 32 S 125-a. Notwithstanding any other provision of law to the contrary, 33 any existing records, property, rights, titles and interest of the Troy 34 urban renewal agency shall vest in and be possessed by the city of Troy 35 and its successors or assigns. 36 S 126. Section 904-b of the general municipal law is REPEALED. 37 S 126-a. Notwithstanding any other provision of law to the contrary, 38 any existing records, property, rights, titles and interest and all 39 obligations and liabilities of the city of Oneida industrial development 40 agency shall vest in and be possessed by the city of Oneida and its 41 successors or assigns. 42 S 127. Section 907-c of the general municipal law is REPEALED. 43 S 127-a. Notwithstanding any other provision of law to the contrary, 44 any existing records, property, rights, titles and interest and all 45 obligations and liabilities of the town of Liberty industrial develop- 46 ment agency shall vest in and be possessed by the town of Liberty and 47 its successors or assigns. 48 S 128. Notwithstanding any other provision of law to the contrary, 6 any existing records, property, rights, titles and interest and all 7 obligations and liabilities of the town of North Hempstead industrial 8 development agency shall vest in and be possessed by the town of North 9 Hempstead and its successors or assigns. 10 S 131. Section 925 of the general municipal law is REPEALED. 11 S 131-a. Notwithstanding any other provision of law to the contrary, 12 any existing records, property, rights, titles and interest and all 13 obligations and liabilities of the Woodridge industrial development 14 agency shall vest in and be possessed by the village of Woodridge and 15 its successors or assigns. 16 S 132. Section 925-e of the general municipal law is REPEALED. 17 S 132-a. Notwithstanding any other provision of law to the contrary, 18 any existing records, property, rights, titles and interest and all 19 obligations and liabilities of the town of Fallsburg industrial develop- 20 ment agency shall vest in and be possessed by the town of Fallsburg and 21 its successors or assigns. 22 S 133. Section 925-u of the general municipal law is REPEALED. 23 S 133-a. Notwithstanding any other provision of law to the contrary, 24 any existing records, property, rights, titles and interest and all 25 obligations and liabilities of the town of Southampton industrial devel- 26 opment agency shall vest in and be possessed by the town of Southampton 27 and its successors or assigns. 28 S 134. Section 927-c of the general municipal law is REPEALED. 29 S 134-a. Notwithstanding any other provision of law to the contrary, 30 any existing records, property, rights, titles and interest and all 31 obligations and liabilities of the town of Altamont industrial develop- 32 ment agency shall vest in and be possessed by the town of Altamont and 33 its successors or assigns. 34 S 135. Separability clause. If any clause, sentence, paragraph, 35 section or part of this act shall be adjudged by any court of competent 36 jurisdiction to be invalid such judgment shall not affect, impair or 37 invalidate the remainder of this act, but shall be confined in its oper- 38 ation to the clause, sentence, paragraph, section or part thereof 39 directly involved in the controversy in which such judgment shall have 40 been rendered. 41 S 136. This act shall take effect on the sixtieth day after it shall 42 have become a law.
