        AN  ACT  to  amend  the social services law, in relation to standards of
          payment for foster care
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
     1    Section  1.  Section  398-a  of  the social services law is amended by
     2  adding a new subdivision 6 to read as follows:
     3    (6) Notwithstanding any provisions of this section  to  the  contrary,
     4  the  office of children and family services shall include, and the divi-
     5  sion of budget shall approve, an increase  for  salaries  equal  to  the
     6  higher  of the three year average in the personal income growth index in
     7  each year's Maximum State  Aid  Rate  ("MSARs")  or  the  Cost-of-Living
     8  Adjustments  ("COLAs")  included in contracts for state employees.  Non-
     9  personal costs and fringe benefits shall be  trended  at  least  by  the
    10  appropriate  applications  of  the consumer price index for the state of
    11  New York.
    12    § 2. This act shall take effect immediately.
