        Introduced  by M. of A. PRETLOW -- read once and referred to the Commit-
          tee on Racing and Wagering  --  committee  discharged,  bill  amended,
          ordered reprinted as amended and recommitted to said committee

        AN  ACT  to  amend the racing, pari-mutuel wagering and breeding law, in
          relation to the discretionary spending  threshold  for  regional  off-
          track betting corporations on food products

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Subdivision 1 of section 507  of  the  racing,  pari-mutuel
     2  wagering  and  breeding  law,  as  amended by chapter 286 of the laws of
     3  1985, is amended to read as follows:
     4    1. a. Each corporation shall let contracts  for  construction  or  any
     5  other  work,  including the furnishing of materials or supplies incident
     6  thereto, and contracts for the purchase  or  procurement  of  equipment,
     7  materials or supplies: (i) in the manner provided by law with respect to
     8  the  letting  of such contracts by counties [except that where the esti-
     9  mated expense of a contract does not exceed  fifteen  thousand  dollars,
    10  such  contract  may  be  entered into without public letting], provided,
    11  however, that where the  corporation  determines  with  respect  to  any
    12  contract that it would not be in the public interest to comply with this
    13  section  and  the  governing body of each county, by resolution, rule or
    14  regulation adopted by the vote of two-thirds  of  the  whole  number  of
    15  votes  authorized to be cast by all of the members of such body, concurs
    16  in such determination, then it may  enter  into  such  contract  without
    17  public  letting as authorized by said resolution, rules and regulations;
    18  (ii) in conjunction with one or more regional off-track  betting  corpo-
    19  rations  pursuant  to  this  section; or (iii) in the manner provided in
    20  section six hundred nine of this chapter if in conjunction with the  New
    21  York city off-track betting corporation.
    22    b.  Notwithstanding  any  other  provision  of  law to the contrary, a
    23  corporation shall have the discretionary spending threshold of  a  state
    24  agency as provided in subdivision six of section one hundred sixty-three
    25  of the state finance law, as it relates to commodities which are consid-
    26  ered  food,   including milk and milk products, or animal or plant fiber

     1  products, grown, produced, harvested, or processed in New York state  or
     2  textile  products    manufactured    from animal or plant fiber grown or
     3  produced predominantly in New York state.
     4    § 2. This act shall take effect immediately.
