          tee on Health
        AN ACT to direct the department of health and the department of environ-
          mental conservation to conduct  a  study  analyzing  linkages  between
          cancer  and  neurological  diseases and contaminated environments; and
          providing for the repeal of such provisions upon expiration thereof
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
     1    Section  1.  Public health study of linkages between cancer and neuro-
     2  logical diseases and environmental contamination. 1. The  department  of
     3  health,  in  cooperation  with the department of environmental conserva-
     4  tion, shall conduct a study of the potential linkages between cancer and
     5  neurological diseases including, but not limited to,  autism  and  amyo-
     6  trophic lateral sclerosis. Such study shall:
     7    a. review all available data related to instances of cancer and neuro-
     8  logical diseases;
     9    b.  review  all  available  data of instances of environmental contam-
    10  ination; and
    11    c. identify any linkages between such data identified in paragraphs  a
    12  and b of this subdivision.
    13    2.  The  department  of  health  and  the  department of environmental
    14  conservation shall then prepare a report to the governor and the  legis-
    15  lature  which  includes  an  analysis  of  the  findings of any linkages
    16  between cancer and neurological diseases and contaminated  environments.
    17  Such report shall be filed within one year of the effective date of this
    18  act, unless the commissioner of health requests in writing, an extension
    19  of time.
    20    3.  For  the  purposes  of this section, "environmental contamination"
    21  shall mean the introduction into water, air and/or soil  of  microorgan-
    22  isms,  chemicals,  toxic  substances, wastes or waste water in a concen-
    23  tration that makes the water, air and/or soil  unfit  for  its  intended
    24  use.
    25    §  2.  This  act shall take effect immediately; (a) provided, however,
    26  that this act shall continue in full force and effect for one year  from

     1  such  effective  date,  or until the department of health reports to the
     2  governor and the legislature as required by section  one  of  this  act,
     3  whichever  date is later, when upon such date the provisions of this act
     4  shall be deemed repealed; and
     5    (b) provided that the commissioner of health shall notify the legisla-
     6  tive bill drafting commission upon filing the report required in section
     7  one  of  this  act in order that the commission may maintain an accurate
     8  and timely effective data base of the official text of the laws  of  the
     9  state  of  New  York  in  furtherance  of effectuating the provisions of
    10  section 44 of the legislative law and section 70-b of the  public  offi-
    11  cers law.
