        AN  ACT to amend the public health law, the education law and the social
          services law, in relation to water testing  in  school  buildings  and
          child day care centers
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1. The public health law is amended by adding  a  new  section
     2  1110 to read as follows:
     3    §  1110. Water testing in school buildings and child day care centers.
     4  1. As used in this section, the following terms shall have the following
     5  meanings:
     6    (a) "water districts" means all community water systems and  non-tran-
     7  sient,  non-community  water  systems  serving  fifteen  or more service
     8  connections or serving twenty-five or more persons; and
     9    (b) "lead action level" means the concentration of lead in  more  than
    10  ten  percent  of one liter first-draw tap water samples collected during
    11  any monitoring period exceeds 0.015 milligrams per liter.
    12    2. All water districts shall test the water in  each  school  building
    13  and child day care center, as defined in section three hundred ninety of
    14  the  social  services  law,  within  the water district for lead contam-
    15  ination every three years.
    16    3. If the lead action level is exceeded at a school building or  child
    17  day  care  center,  the  water  district shall notify the child day care
    18  center or the school district in which the school building  is  located.
    19  The parents of children attending such affected school building or child
    20  day  care  center  shall  be  notified  in  accordance with section four
    21  hundred nine-l of the education law or section three hundred ninety-k of
    22  the social services law.
    23    § 2. The education law is amended by adding a  new  section  409-l  to
    24  read as follows:
    25    §  409-l.  Water testing in school buildings. 1. When the water in any
    26  school building in a school district is found to exceed the lead  action
