STATE OF NEW YORK ________________________________________________________________________ 10364 IN ASSEMBLY May 21, 2024 ___________ Introduced by COMMITTEE ON RULES -- (at request of M. of A. Bores) -- read once and referred to the Committee on Science and Technology AN ACT to amend the general business law, in relation to requiring the registration of certain companies whose primary business purpose is related to artificial intelligence The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The general business law is amended by adding a new article 2 2-A to read as follows: 3 ARTICLE 2-A 4 REGISTRATION OF CERTAIN ARTIFICIAL INTELLIGENCE COMPANIES 5 Section 20. Registration requirements. 6 20-a. Penalties. 7 § 20. Registration requirements. 1. The secretary of state shall 8 require the biennial registration of any company, partnership, limited 9 liability company or corporation whose North American Industry Classi- 10 fication System (NAIC) code is any of the following: 11 (a) 541512; 12 (b) 334220; or 13 (c) 513210. 14 2. This section shall apply to any business located in this state or 15 which sells products or services in this state. 16 3. The secretary of state shall impose a fee of two hundred dollars 17 for each biannual registration. 18 § 20-a. Penalties. A violation of this article shall be punishable by 19 a fine of up to ten thousand dollars. Additionally, the attorney general 20 may seek an injunction to bar any company, partnership, limited liabil- 21 ity company or corporation which knowingly fails to register pursuant to 22 this article from operating or selling any artificial intelligence 23 products or services in this state for a period of up to ten years. 24 § 2.
