        AN ACT to amend the education law, in relation to establishing an  auto-
          matic application system

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Article 3 of the education law is amended by adding  a  new
     2  part 6 to read as follows:

     5  Section 190. Automatic application program; established.
     6          191. Program requirements.
     7          192. Data publication.
     8          193. Program promotion.
     9          194. Rulemaking authority.
    10    §  190.  Automatic  application  program; established. There is hereby
    11  established an automatic application program to be administered  by  the
    12  department.
    13    § 191. Program requirements. 1. The department shall promulgate stand-
    14  ards for the automatic application of graduating high school students in
    15  New  York  state  that comply with the federal family educational rights
    16  and privacy act.   No personal  information  shall  be  shared  with  an
    17  external  entity  without  the  express  consent  from  a student having
    18  attained the age of eighteen or, in the case of students seventeen years
    19  of age or younger, parental consent.
    20    2. It shall be the responsibility of  the  department  to  create  and
    21  maintain a centralized academic database:
    22    (a)  to provide an online account for each student in the beginning of
    23  their senior year of high school through which students  may  apply  for
    24  admission  into the state university of New York and the city university
    25  of New York;
    26    (b) to preload the demographic and academic information  available  to
    27  the  department  into such account required on an application for admis-

     1  sion into such institution of each student at  the  beginning  of  their
     2  senior year of high school.
     3    3.  A  student may decline to participate in the automatic application
     4  program by decision made prior to the beginning of their junior year and
     5  at any time or point in the application  process.  The  student  retains
     6  sole  discretion  over whether to submit an application. The application
     7  fee shall be borne by the student.
     8    4. A student who applies pursuant to the automatic application program
     9  and meets the standards promulgated by the department pursuant to subdi-
    10  vision one of this section shall be accepted  for  admission  into  such
    11  universities.
    12    5.  Student data shall be deleted in compliance with federal and state
    13  regulations.
    14    6. The department shall provide estimates of anticipated financial aid
    15  based on data submissions on student applications prior to submission of
    16  the application.
    17    § 192. Data publication. The department shall collect and  publish  an
    18  annual  report  assessing the effectiveness of the automatic application
    19  program. The report shall include data of  accepted  students  disaggre-
    20  gated by race, ethnicity, socioeconomic status, geographic location, and
    21  high school institution.
    22    §  193. Program promotion. The department shall create and implement a
    23  program to inform high schools and the general public about the automat-
    24  ic application program.
    25    § 194. Rulemaking authority.  The  department  shall  promulgate  such
    26  regulations  of  the  commissioner  as may be necessary to carry out the
    27  provisions of this article.
    28    § 2. This act shall take effect on the first of August next succeeding
    29  the date on which it shall have become a law.
