STATE OF NEW YORK ________________________________________________________________________ 10553 IN ASSEMBLY June 2, 2016 ___________ Introduced by COMMITTEE ON RULES -- (at request of M. of A. Blake) -- read once and referred to the Committee on Ways and Means AN ACT to amend the state finance law, in relation to the definition of "small business"; and to amend chapter 568 of the laws of 2015, amend- ing the state finance law relating to requiring state agencies to pay small businesses within fifteen days of receipt of an invoice, in relation to the effectiveness thereof The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 6 of section 179-f of the state finance law, as 2 amended by chapter 36 of the laws of 2016, is amended to read as 3 follows: 4 6. As used in this section, "small business" shall mean a business 5 whose primary place of business is in New York state, has a significant 6 business presence in the state, is independently owned and operated, not 7 dominant in its field, and employs no more than two hundred employees at 8 the time of [the award contracting and] payment. The ["]small busi- 9 ness["] shall, upon request, provide the contracting entity with suffi- 10 cient documentation to reflect and confirm its status as a small busi- 11 ness. 12 § 2. Section 2 of chapter 568 of the laws of 2015, amending the state 13 finance law relating to requiring state agencies to pay small businesses 14 within fifteen days of receipt of an invoice, as amended by chapter 36 15 of the laws of 2016, is amended to read as follows: 16 § 2. This act shall take effect on [the three hundred sixty-fifth day17after it shall have become a law] March 31, 2017 and shall apply only to 18 invoices received after such date. 19 § 3. This act shall take effect on the same date and in the same 20 manner as chapter 568 of the laws of 2015, amending the state finance 21 law relating to requiring state agencies to pay small businesses within 22 fifteen days of receipt of an invoice, as amended, takes effect.
