        AN ACT to amend the vehicle and traffic law, in relation to establishing
          a reimbursement program encouraging persons  to  scrap  such  person's
          petroleum or diesel motor vehicle to purchase a zero emission or elec-
          tric motor vehicle

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. The vehicle and traffic law is  amended  by  adding  a  new
     2  section 224-b to read as follows:
     3    §  224-b.  Establishment of the scrap for electric vehicle program. 1.
     4  For the purposes of this section, "eligible vehicle" means and  includes
     5  a new motor vehicle that:
     6    (a) has four wheels;
     7    (b)  was  manufactured  for use primarily on public streets, roads and
     8  highways;
     9    (c) the powertrain of which has not been modified  from  the  original
    10  manufacturer's specifications;
    11    (d) is rated at not more than eight thousand five hundred pounds gross
    12  vehicle weight; and
    13    (e)  is propelled at least in part by an electric motor and associated
    14  power electronics which provide acceleration torque to the drive  wheels
    15  sometime  during  normal  vehicle  operation, and that draws electricity
    16  from a hydrogen fuel cell or from a battery that:
    17    (i) has a capacity of not less than four kilowatt hours; and
    18    (ii) is capable of being recharged from an external  source  of  elec-
    19  tricity.
    20    2.  The  department  shall  develop  a program to encourage persons to
    21  scrap such person's petroleum or diesel motor vehicle to purchase a zero
    22  emission or electric motor vehicle. Such program shall include a  rebate
    23  for purchasing such eligible vehicle provided that a rebate for purchas-
    24  ing such eligible vehicle shall not exceed five hundred dollars.
    25    3.  The  department  shall  determine  and  establish  the forms to be
    26  required to claim a rebate, the required documentation for  establishing

     1  eligibility  for  a  rebate, and any other procedures and guidelines for
     2  claiming a rebate pursuant to this section.
     3    §  2. This act shall take effect one year after it shall have become a
     4  law. Effective immediately, the addition, amendment and/or repeal of any
     5  rule or regulation necessary for the implementation of this act  on  its
     6  effective date are authorized to be made and completed on or before such
     7  date.
