KAPLAN -- read twice and ordered printed, and when printed to be committed to the Committee on Internet and Technology -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the economic development law, in relation to creating the mobile high-technology training facilities program The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The economic development law is amended by adding a new 2 section 361 to read as follows: 3 § 361. Mobile high-technology training facilities program. 1. The 4 division is hereby authorized to create a mobile high-technology train- 5 ing facilities program. The purpose of the program is to award one to 6 one matching grants on a competitive basis to qualified applicants for 7 the design, development and/or outfit of mobile high-technology training 8 facilities that complement certificate, degree or other recognized 9 credentialing programs. Such program shall be established by the divi- 10 sion within ninety days from the effective date of this section. 11 2. For purposes of this section, the following terms shall have the 12 following meanings: 13 (a) "Qualified applicant" means any educational or not-for-profit 14 institution providing certificate, degree or other credentialing 15 programs in high-technology fields including, but not limited to, nano- 16 technology, biotechnology, advanced manufacturing processes and informa- 17 tion technology or any other field defined as an emerging technology by 18 paragraph (b) of subdivision one of section thirty-one hundred two-e of 19 the public authorities law. 20 (b) "Division" means the division of science, technology and inno- 21 vation. Applicants shall submit an application to the division comprising a 2 plan including, but not limited to: 3 (a) demonstration that funds and/or other in-kind contributions are 4 encumbered in an amount not less than twenty percent of requested grant 5 amount; 6 (b) the design and implementation of a facility including the use of 7 simulation-based education and training resources including the types of 8 machinery, equipment and staffing level required; 9 (c) demonstration of a flexible program which would allow for diversi- 10 fied job training skills within a particular industry; 11 (d) evidence that a need for employees related to the industry associ- 12 ated with the applicant exists; 13 (e) development of a curriculum to deliver such mobile training facil- 14 ity to each regionally defined location in the state lacking similar 15 training opportunities including the period of time required to 16 adequately train an individual and the estimated number of participants 17 utilizing such facility in a given year; 18 (f) demonstration of a collaborative and/or cooperative working 19 relationship with private employers to ensure that facilities meet 20 industry-specific job training requirements; and 21 (g) demonstration of an ability to maintain such mobile facility on an 22 on-going basis, including but not limited to self-sustainability regard- 23 ing staffing, operating, maintenance and adaptability. 24 4. The division shall establish any additional criteria to be used in 25 the evaluation of applications. 26 5. The division shall submit a report, within one year from the effec- 27 tive date of this section and annually thereafter, to the governor and 28 the legislature regarding the outcomes of the program including, but not 29 limited to grant recipients, purpose of mobile training facility, 30 locations visited, number of participants utilizing facility and actual 31 employment obtained through the use of such facility. 32 § 2. This act shall take effect immediately.
