RHOADS -- read twice and ordered printed, and when printed to be committed to the Committee on Civil Service and Pensions AN ACT to amend the civil service law, in relation to providing addi- tional credits to Nassau county law enforcement explorers The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Short title. This act shall be known and may be cited as 2 the "Nassau future protectors act". 3 § 2. The civil service law is amended by adding a new article 6-A to 4 read as follows: 5 ARTICLE 6-A 6 SPECIAL RIGHTS FOR NASSAU COUNTY LAW ENFORCEMENT EXPLORERS 7 Section 89. Additional credit allowed for Nassau county law enforcement 8 explorers in competitive examinations; preference in 9 retention upon abolition of positions. 10 § 89. Additional credit allowed for Nassau county law enforcement 11 explorers in competitive examinations; preference in retention upon 12 abolition of positions. 1. Additional credits shall be allowed for 13 participants of the Nassau county law enforcement exploring program in 14 competitive examinations for original appointment. The Nassau county law 15 enforcement exploring program shall be defined as a youth police train- 16 ing program which provides youths between the ages of fourteen and twen- 17 ty with training and on the purpose, mission and objectives of the 18 Nassau county police department, public safety and law enforcement. 19 (a) On all eligible lists resulting from competitive examinations, the 20 names of eligible persons shall be entered in the order of respective 21 final earned ratings on examinations, with the name of the eligible 22 person with the highest final earned ratings at the head of such list, 23 provided, however, that for the purpose of determining final earned 24 ratings, Nassau county law enforcement explorers shall be entitled to EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD02650-01-5S. 712 2 1 receive additional points in a competitive examination for original 2 appointment in Nassau county. An eligible person who served as a Nassau 3 county law enforcement explorer for a minimum of four years shall 4 receive an additional five points. An eligible person who served as a 5 Nassau county law enforcement explorer for less than four years shall 6 receive an additional two points. 7 (b) Such additional credit shall be added to the final earned rating 8 of such Nassau county law enforcement explorer, after such explorer 9 qualified in the competitive examination and shall be granted only at 10 the time of establishment of the resulting eligible list. 11 2. Any candidate, believing themselves to be entitled to additional 12 credit in a competitive examination as provided in this section, may 13 make application for such additional credit at any time between the date 14 of application for examination and the date of the establishment of the 15 resulting eligible list. Such candidates shall be allowed a period of 16 not less than two months from the date of the filing of the application 17 for examination in which to establish by appropriate documentary proof 18 the eligibility to receive additional credit under this section. At any 19 time after two months have elapsed since the final date for filing 20 applications for a competitive examination for original appointment, the 21 eligible list resulting from such examination may be established, 22 notwithstanding the fact that a Nassau county law enforcement explorer 23 who has applied for additional credit has failed to establish the eligi- 24 bility to receive such additional credit. A candidate who fails to 25 establish, by appropriate documentary proof, the eligibility to receive 26 additional credit by the time an eligible list is established shall not 27 thereafter be granted additional credit on such eligible list. 28 3. (a) Except as otherwise provided in this subdivision, no person who 29 has received a permanent original appointment in the civil service of 30 Nassau county thereof from an eligible list on which such person was 31 allowed the additional credit granted by this section as a Nassau county 32 law enforcement explorer, shall thereafter be entitled to any additional 33 credit under this section. 34 (b) Where, at the time of establishment of an eligible list, the posi- 35 tion of a Nassau county law enforcement explorer on such list has not 36 been affected by the addition of credits granted under this section, the 37 appointment of such Nassau county law enforcement explorer from such 38 eligible list shall not be deemed to have been made from an eligible 39 list on which they were allowed the additional credit granted by this 40 section. 41 (c) If, at the time of appointment from an eligible list, a Nassau 42 county law enforcement explorer is in the same relative standing among 43 the eligible persons who are willing to accept appointment as if such 44 explorer had not been granted the additional credits as provided by this 45 section, the appointment from such eligible persons shall not be deemed 46 to have been made from an eligible list on which they were allowed such 47 additional credits. 48 (d) Where a Nassau county law enforcement explorer has been originally 49 appointed from an eligible list on which such explorer was allowed such 50 additional credit, but such appointment is thereafter terminated either 51 at the end of the probationary term or by resignation at or before the 52 end of the probationary term, such explorer shall not be deemed to have 53 been appointed, as the case may be, from an eligible list on which such 54 explorer is allowed additional credit, and such appointment shall not 55 affect such explorer's eligibility for additional credit in other exam- 56 inations.S. 712 3 1 4. An application for additional credit in a competitive examination 2 under this section may be withdrawn by the applicant at any time prior 3 to the establishment of the resulting eligible list. At any time during 4 the term of existence of an eligible list resulting from a competitive 5 examination in which a Nassau county law enforcement explorer has 6 received the additional credit granted by this section, such Nassau 7 county law enforcement explorer may elect, prior to permanent original 8 appointment, to relinquish the additional credit granted and accept the 9 lower position on such eligible list to which such explorer would other- 10 wise have been entitled; provided, however, that such election shall 11 thereafter be irrevocable. Such election shall be in writing and signed 12 by the Nassau county law enforcement explorer, and transmitted to the 13 department or the appropriate municipal civil service commission. 14 5. The department and each municipal commission shall establish and 15 maintain in its office a roster of all such Nassau county law enforce- 16 ment explorers appointed as a result of additional credits granted by 17 this section to positions under its jurisdiction. The appointment of a 18 Nassau county law enforcement explorer as a result of additional credits 19 shall be void if such Nassau county law enforcement explorer, prior to 20 such appointment, had been appointed as a result of additional credits 21 granted by this section. 22 § 3. This act shall take effect immediately.
