STATE OF NEW YORK ________________________________________________________________________ 1418 2017-2018 Regular Sessions IN SENATE January 9, 2017 ___________ Introduced by Sen. AVELLA -- read twice and ordered printed, and when printed to be committed to the Committee on Cities AN ACT to amend the administrative code of the city of New York, in relation to home improvement contractors The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 2 of section 20-386 of the administrative code 2 of the city of New York, as amended by local law 23 of the city of New 3 York for the year 1996, is amended to read as follows: 4 2. "Home improvement" means the construction, repair, replacement, 5 remodeling, alteration, conversion, rehabilitation, renovation, modern- 6 ization, improvement, or addition to any land or building, or that 7 portion thereof which is used or designed to be used as a residence or 8 dwelling place and shall include but not be limited to the construction, 9 erection, replacement, or improvement of driveways, swimming pools, 10 terraces, patios, landscaping, fences, porches, garages, fallout shel- 11 ters, basements, and other improvements to structures or upon land which 12 is adjacent to a dwelling house. "Home improvement" shall not include 13 (i) [the construction of a new home or building or work done by a14contractor in compliance with a guarantee of completion of a new build-15ing project, (ii)] the sale of goods or materials by a seller who 16 neither arranges to perform nor performs directly or indirectly any work 17 or labor in connection with the installation of or application of the 18 goods or materials, [(iii)] (ii) residences owned by or controlled by 19 the state or any municipal subdivision thereof, or [(iv)] (iii) painting 20 or decorating of a building, residence, home or apartment, when not 21 incidental or related to home improvement work as [herein] defined in 22 this section. Without regard to the extent of affixation, "home improve- 23 ment" shall also include the installation of central heating or air 24 conditioning systems, central vacuum cleaning systems, storm windows, 25 awnings or communication systems. 26 § 2.
