        AN ACT to amend the public health law,  in  relation  to  cardiovascular
          technologists
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1. Subdivision 4 of section 3502 of the public health law,  as
     2  amended  by  chapter  175  of  the  laws  of 2006, is amended to read as
     3  follows:
     4    4. (a) No radiologic technologist shall administer or inject  intrave-
     5  nous  contrast media unless [(a)] (i) the individual is certified by the
     6  department to perform such function in accordance with  the  commission-
     7  er's  rules  and regulations [(b)] (ii) such administration or injection
     8  has been approved by a physician, physician's assistant,  nurse  practi-
     9  tioner  or  registered professional nurse within twenty-four hours prior
    10  to the administration or injection [(c)] (iii) a physician,  physician's
    11  assistant,  nurse practitioner or registered professional nurse performs
    12  an evaluation of the patient on the day of the procedure. Administration
    13  or injection of contrast media means and is limited to the placement  or
    14  insertion  of  a  needle  or  a  catheter, not exceeding three inches in
    15  length and not above the level of  the  axilla  into  a  person's  upper
    16  extremity  and  the  administration  or  injection  of  the  intravenous
    17  contrast media, manually or by mechanical injector, but  does  not  mean
    18  the  determination  of the type or volume of media to be administered or
    19  injected.

     1    (b) Nothing in this article or in any other  provision  of  law  shall
     2  prevent  a cardiovascular technologist, acting under the personal super-
     3  vision of a physician, from introducing contrast  medium  to  a  patient
     4  during  a  cardiovascular diagnostic or interventional procedure through
     5  an  arterial line placed by a licensed practitioner. The introduction of
     6  contrast medium in preparation of or during such  procedures  shall  not
     7  constitute  the  administration  of  medication for the purposes of this
     8  section.
     9    § 2. This act shall take effect immediately.
