          when printed to be committed to the Committee on Women's Issues

        AN ACT to amend the public health law,  in  relation  to  the  statewide
          fibroid study program; and to amend the state finance law, in relation
          to establishing the statewide fibroid study program fund

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1.  The public health law is amended by adding a  new  section
     2  267-c to read as follows:
     3    §  267-c.  Statewide  fibroid study program. 1. The commissioner shall
     4  establish within  the  department  a  statewide  fibroid  study  program
     5  through  which  the department will study and evaluate the occurrence of
     6  fibroids and the alleviation  of  pain  caused  by  these  tumors.  This
     7  program shall:
     8    (a) examine and evaluate current research and progress in the study of
     9  fibroids;
    10    (b) examine and evaluate current treatment methods for fibroids;
    11    (c) identify potential barriers to access to treatment for fibroids;
    12    (d) examine the symptoms and effects of fibroids on women of color;
    13    (e)  identify  any  potential  barriers  to  access  to  treatment for
    14  fibroids, in addition to barriers identified pursuant to  paragraph  (h)
    15  of this subdivision, for women of color;
    16    (f)  make  recommendations as the development of treatment methods for
    17  fibroids;
    18    (g) make recommendations to remove any potential barriers to access to
    19  treatment of fibroids; and
    20    (h) make recommendations to remove any potential barriers to access to
    21  treatment of fibroids specific to potential barriers to access to treat-
    22  ment faced by women of color.
    23    2. Any entity dedicated to  the  advancement  of  reproductive  health
    24  shall  be  eligible  to  submit  applications  to receive funds from the

     1  department for the purpose of advancing the study of fibroids.  A  grant
     2  may be awarded upon submission of an application to the department.
     3    3.  On or before the first day of February each year, the commissioner
     4  shall provide a written report to the temporary president of the senate,
     5  speaker of the assembly, chair of the senate finance committee, chair of
     6  the assembly ways and means committee, chair of the senate committee  on
     7  health,  chair  of  the assembly health committee, the state comptroller
     8  and the public. Such report shall include how the  monies  of  the  fund
     9  were utilized during the preceding calendar year, and shall include:
    10    (a)  the  amount of money disbursed from the fund and the process used
    11  for such disbursements;
    12    (b) recipients of awards from the fund;
    13    (c) the amount awarded to each;
    14    (d) the purposes for which such awards were granted; and
    15    (e) a summary financial plan for such monies which shall include esti-
    16  mates of all receipts and all disbursements for the current and succeed-
    17  ing fiscal years, along with the actual results from  the  prior  fiscal
    18  year.
    19    §  2.  The  state finance law is amended by adding a new section 87 to
    20  read as follows:
    21    § 87. Statewide fibroid study program fund. 1. There is hereby  estab-
    22  lished  in  the  custody  of  the state comptroller a special fund to be
    23  known as the "statewide fibroid study program fund".
    24    2. The sources of funds shall consist of all moneys  collected  there-
    25  for,  or  moneys  credited or transferred thereto from any other fund or
    26  source pursuant to law, or any  other  moneys  made  available  for  the
    27  purposes of such fund.
    28    3.  (a)  Moneys  of  such  fund shall be expended to the department of
    29  health to study fibroids and the alleviation of pain caused by fibroids.
    30    (b) The department of health may also provide grants for  the  purpose
    31  of advancing the study of fibroids.
    32    4.  Monies  shall be payable from the fund on the audit and warrant of
    33  the comptroller on vouchers approved and certified by  the  commissioner
    34  of health.
    35    § 3. This act shall take effect immediately.
