       Introduced  by  Sen. MORAHAN -- read twice and ordered printed, and when
         printed to be committed to the Committee on Education
       AN ACT to amend the education law, in  relation  to  access  to  observe
         programs for children with handicapping conditions
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Subparagraph 3 of paragraph b of subdivision 1  of  section
    2  4402  of the education law is amended by adding a new clause (m) to read
    3  as follows:
    4    (M) EACH SCHOOL DISTRICT SHALL ALLOW PARENTS, GUARDIANS AND  INDEPEND-
    5  ENT  EVALUATORS  ACCESS  TO  OBSERVE  THE  CURRENT OR PROPOSED PROGRAMS,
    6  SERVICES, AND FACILITIES MADE AVAILABLE BY  THE  SCHOOL  DISTRICT  TO  A
    7  PUPIL  SERVED  UNDER  THIS  ARTICLE.  THE  PARENT  OR PERSON IN PARENTAL
    8  RELATION OF A CHILD WITH A HANDICAPPING CONDITION SHALL HAVE FULL ACCESS
    9  TO OBSERVE THE EDUCATIONAL PROGRAM OF SUCH STUDENT.
   10    S 2. This act shall take effect immediately.
