STATE OF NEW YORK ________________________________________________________________________ 4098 2019-2020 Regular Sessions IN SENATE February 28, 2019 ___________ Introduced by Sen. RANZENHOFER -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend chapter 635 of the laws of 1963 relating to incorporat- ing the Snyder Volunteer Firemen's Benevolent Association, in relation to its purpose and the use of foreign fire insurance premium taxes The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Sections 3 and 7 of chapter 635 of the laws of 1963, relat- 2 ing to incorporating the Snyder Volunteer Firemen's Benevolent Associ- 3 ation, are amended to read as follows: 4 § 3. Purposes. [The purposes of such corporation shall be the5promotion of fraternal intercourse among the members of such corpo-6ration, the relief, aid and assistance of such members and their fami-7lies who are disabled or indigent, and the promotion of the welfare of8the fire department service within the Snyder Fire District and territo-9ry provided with fire protection by contract with such fire district.] 10 The purposes of the corporation created by this act are: to provide 11 relief, aid and assistance to the volunteer members of such corporation 12 who are disabled or injured in the performance of their duties, and 13 their families; to promote and safeguard the welfare of the volunteer 14 members of the corporation, and their families; to provide for the 15 health and safety of the volunteer members of the corporation; and to 16 enhance the morale of the volunteer members of the corporation by 17 providing social and recreational activities for the volunteer members 18 of the corporation, and the promotion of the volunteer fire service 19 within the territory protected by such fire department of the Snyder 20 Fire Department, Incorporated. 21 § 7. Precept for payment of foreign fire insurance premium taxes. Such 22 corporation shall collect and there shall be paid to it all taxes 23 imposed by former section five hundred fifty-three of the insurance law, 24 for fire department use and benefit, upon premiums for insurance against EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD10292-01-9S. 4098 2 1 loss or damage by fire covering property situated within the territory 2 protected by the Snyder Fire Department, Incorporated, located in the 3 Town of Amherst, Erie County, New York, or within any duly organized 4 territory in which the Snyder Fire Department, Incorporated is or may be 5 obligated to render fire protection. The officer of said corporation 6 designated by its by-laws to collect and receive the aforesaid tax shall 7 have all the powers and be subject to all the provisions of the insur- 8 ance law, relating to treasurers of the fire departments. Such corpo- 9 ration shall also be entitled to receive a share of the tax imposed by 10 former section five hundred fifty-four on the insurance law, based upon 11 the business written in the territory with respect to which it is enti- 12 tled to collect and receive the tax under former section five hundred 13 fifty-three of the insurance law. [Such taxes shall only be used for the14care and relief of disabled or indigent volunteer and exempt volunteer15firemen and their families.] 16 § 2. This act shall take effect immediately.
