STATE OF NEW YORK ________________________________________________________________________ 4498 2019-2020 Regular Sessions IN SENATE March 13, 2019 ___________ Introduced by Sen. RIVERA -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to the establishment of obstetric hemorrhage protocols; and providing for the repeal of certain provisions upon the expiration thereof The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 1 of section 206 of the public health law is 2 amended by adding a new paragraph (w) to read as follows: 3 (w) provide guidance to hospitals on obstetric hemorrhage protocols, 4 in consultation with clinical experts, and develop or identify an exist- 5 ing toolkit on obstetric hemorrhage management, which may include a 6 hemorrhage care checklist for use by hospitals as part of the protocols 7 and guidance on simulation training. The commissioner shall report to 8 the temporary president of the senate and the speaker of the assembly on 9 data collected pursuant to paragraph (c) of subdivision one of section 10 twenty-eight hundred three-n of this chapter within two years from the 11 effective date of this paragraph, and biennially thereafter. 12 § 2. Subdivision 1 of section 2803-n of the public health law is 13 amended by adding a new paragraph (c) to read as follows: 14 (c) The hospital shall adopt, implement, periodically update and 15 submit to the department standard protocols for management of obstetric 16 hemorrhage. Such protocols shall address early recognition and assess- 17 ment, readiness to respond in a multidisciplinary manner, and data 18 reporting to the department sufficient for the department to monitor and 19 report pursuant to paragraph (w) of subdivision one of section two 20 hundred six of this chapter. Such protocols shall utilize risk assess- 21 ment tools such as the toolkit established or identified by the depart- 22 ment under paragraph (w) of subdivision one of section two hundred six 23 of this chapter and shall include a response plan providing for the 24 triage and transfer to higher level facilities if needed. This act shall take effect on the ninetieth day after it shall 2 have become a law; provided, however, that the amendments to section 206 3 of the public health law made by section one of this act shall expire 4 and be deemed repealed January 31, 2028.
