        AN ACT to amend the education law, in relation  to  authorizing  pharma-
          cists to administer injections for contraceptive use

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Section 6527 of the education law is amended  by  adding  a
     2  new subdivision 7-b to read as follows:
     3    7-b.  A  licensed physician may prescribe and order a patient specific
     4  order or a non-patient specific order to a licensed pharmacist, pursuant
     5  to regulations promulgated by the commissioner in consultation with  the
     6  commissioner  of  health, and consistent with the public health law, for
     7  the administration of injections  of  a  hormone  or  a  combination  of
     8  hormones  that  is  approved by the United States Food and Drug Adminis-
     9  tration for the purpose of contraceptive use.
    10    § 2. Subdivision 22 of section 6802 of the education law is amended by
    11  adding a new paragraph c to read as follows:
    12    c. The injection of a hormone or a combination  of  hormones  that  is
    13  approved  by  the  United  States  Food  and Drug Administration for the
    14  purpose of contraceptive use, as prescribed or  ordered  by  a  licensed
    15  prescriber,  acting within the scope of their practice in this state and
    16  in accordance  with  regulations  promulgated  by  the  commissioner  in
    17  consultation  with  the  department  of  health, and consistent with the
    18  public health law.
    19    § 3. Section 6801 of the education law is  amended  by  adding  a  new
    20  subdivision 9 to read as follows:
    21    9.  A  licensed  pharmacist  within their lawful scope of practice may
    22  administer injectable medications of  a  hormone  or  a  combination  of
    23  hormones  that  is  approved by the United States Food and Drug Adminis-
    24  tration for the purpose of contraceptive use, pursuant  to  section  six
    25  thousand  eight hundred two of this article, as prescribed or ordered by

     1  a licensed prescriber, acting within the scope of their practice in this
     2  state and in accordance with regulations promulgated by the commissioner
     3  in consultation with the department of health, and consistent  with  the
     4  public health law. A pharmacist who administers contraceptive injections
     5  pursuant  to this subdivision shall not require a patient to schedule an
     6  appointment with the pharmacist for the administering  of  contraceptive
     7  injections.
     8    §  4.  Section  6909  of  the education law is amended by adding a new
     9  subdivision 11 to read as follows:
    10    11. A certified nurse practitioner may prescribe and order  a  patient
    11  specific order or a non-patient specific order to a licensed pharmacist,
    12  pursuant  to regulations promulgated by the commissioner in consultation
    13  with the commissioner of health, and consistent with the  public  health
    14  law,  for the administration of injections of a hormone or a combination
    15  of hormones that is approved by the United States Food and Drug Adminis-
    16  tration for the purpose of contraceptive use.
    17    § 5. This act shall take effect one year after it shall have become  a
    18  law. Effective immediately, the addition, amendment and/or repeal of any
    19  rule  or  regulation necessary for the implementation of this act on its
    20  effective date are authorized to be made and completed on or before such
    21  date.
