STATE OF NEW YORK ________________________________________________________________________ 5796 2019-2020 Regular Sessions IN SENATE May 15, 2019 ___________ Introduced by Sen. CARLUCCI -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern- ment Operations AN ACT authorizing the commissioner of general services to transfer and convey certain unappropriated state land to the village of Ossining, county of Westchester The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subject to the provisions of this act but notwithstanding 2 any other provision of law to the contrary, the commissioner of general 3 services is hereby authorized, subject to the consent of the commission- 4 er of corrections and community supervision, to transfer and convey to 5 the village of Ossining in the county of Westchester, the state land 6 described in section two of this act, owned by the department of 7 corrections and community supervision and being a part of lot 97.12-1-4, 8 in the village of Ossining in the county of Westchester, declared to be 9 abandoned state land by the department of corrections and community 10 supervision. The transfer and conveyance of the land described in 11 section two of this act shall be made in consideration of the sum of one 12 dollar and upon such conditions as the commissioner of general services 13 may deem proper. If the transfer and conveyance of such land shall not 14 have taken effect within two years of the effective date of this act, 15 then such authority to transfer and convey shall be revoked. 16 § 2. The lands authorized by section one of this act to be transferred 17 and conveyed are as follows: 18 A piece of land situate in the village of Ossining, County of West- 19 chester, State of New York, being a portion of parcel with Tax ID: 20 97.10-1-4 and being more particularly described as follows: a portion 21 equaling 1.7 acres that includes the Sing Sing Correctional Facility 22 1936 Powerhouse. Subject to any enforceable easements, restrictions or 23 covenants of record that may exist. EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD11670-02-9S. 5796 2 1 § 3. The description in section two of this act is not intended to be 2 a legal description, but is intended to identify the parcel to be 3 conveyed. As a condition of the transfer, the village of Ossining may 4 submit to the commissioner of general services, for his or her approval, 5 an accurate survey and description of the lands to be conveyed, which 6 may be used in the conveyance thereof. 7 § 4. The office of general services shall not transfer or convey the 8 aforesaid land unless the application is made to the office of general 9 services by the village of Ossining within one year after the effective 10 date of this act. Said application shall be in the form of a resolution 11 setting forth a comprehensive statement approved by the Ossining's 12 Village Board of Trustees acknowledging and accepting the use 13 restrictions set forth in section five of this act. 14 § 5. The transfer and conveyance made pursuant to this act shall be 15 subject to the following use restrictions and reverter: 16 (a) The land described in this act shall be used exclusively for the 17 purposes of operating and maintaining a museum. 18 (b) The conveyance of the land described in this act shall contain a 19 covenant and restriction requiring that the land be used for the purpose 20 set forth in subdivision (a) of this section. In the event the premises 21 are not accepted and/or used for such purposes, ownership of the land 22 shall revert to the state of New York. 23 § 6. This act shall take effect immediately.
