STATE OF NEW YORK ________________________________________________________________________ 5805 2019-2020 Regular Sessions IN SENATE May 15, 2019 ___________ Introduced by Sen. MAYER -- read twice and ordered printed, and when printed to be committed to the Committee on Labor AN ACT to amend the labor law, in relation to requiring certain employ- ers to register for emergency alerts from the state of New York public safety alert mass notification system The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The labor law is amended by adding a new section 219-d to 2 read as follows: 3 § 219-d. Emergency alert notification system required employer regis- 4 tration. 1. Each employer located within the state that employs five or 5 more employees, shall register with the state office of information 6 technology services alert system known as alert.ny.gov to facilitate the 7 timely distribution of information from the state concerning critical 8 information about emergency incidents or occurrences which pose a poten- 9 tial imminent threat to the health or safety of the employees of such 10 employers. 11 2. Each employer subject to this section, after receiving an alert 12 notification from such mass alert notification system, shall dissem- 13 inate, when appropriate, information relating to such notification in a 14 timely manner to each employee and shall do so through at least one of 15 the following communication methods: 16 (a) automated delivery of text messages; 17 (b) phone calls; or 18 (c) electronic mail. 19 3. Each employer subject to this section shall create a plan and 20 procedures for determining when dissemination of information is appro- 21 priate, how to disseminate such information, and any action that the 22 employer shall take in response to such information in order to preserve 23 the health and safety of their employees. 24 § 2.
