STATE OF NEW YORK ________________________________________________________________________ 5899 2017-2018 Regular Sessions IN SENATE May 5, 2017 ___________ Introduced by Sen. GALLIVAN -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to the regis- tration of vessels and historic, antique and classic designations The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 3 of section 2251 of the vehicle and traffic 2 law, as amended by section 5 of part G of chapter 59 of the laws of 3 2009, is amended and a new subdivision 10 is added to read as follows: 4 3. Fees. The triennial fee for registration of a vessel shall be: 5 twenty-two dollars and fifty cents and a vessel surcharge of three 6 dollars and seventy-five cents, if less than sixteen feet in length; 7 forty-five dollars and a vessel surcharge of twelve dollars and fifty 8 cents, if sixteen feet or over but less than twenty-six feet in length; 9 seventy-five dollars and a vessel surcharge of eighteen dollars and 10 seventy-five cents, if twenty-six feet or over. There shall be an addi- 11 tional vessel surcharge of twenty dollars for all vessels that have a 12 historic, antique or classic designation. All funds derived from the 13 collection of the vessel access surcharge pursuant to this subdivision 14 are to be deposited in a subaccount of the "I love NY waterways" vessel 15 access account established pursuant to section ninety-seven-nn of the 16 state finance law. The vessel access surcharge shall not be considered a 17 registration fee for purposes of section seventy-nine-b of the naviga- 18 tion law. 19 Notwithstanding any inconsistent provision of this section, the differ- 20 ence collected between the fees set forth in this subdivision in effect 21 on and after September first, two thousand nine and the fees set forth 22 in this subdivision prior to such date shall be deposited to the credit 23 of the dedicated highway and bridge trust fund. Notwithstanding any 24 inconsistent provision of this section, the difference collected between 25 the vessel surcharge set forth in this subdivision in effect on and EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD09334-01-7S. 5899 2 1 after September first, two thousand nine and the vessel surcharge set 2 forth in this subdivision in effect prior to such date shall be deposit- 3 ed to the credit of the dedicated highway and bridge trust fund. 4 10. Historic, antique or classic designation. The owner of each vessel 5 requesting a historic, antique or classic designation shall present an 6 application for said designation to the commissioner, or an agent desig- 7 nated by the commissioner, on a form to be prepared and furnished by the 8 commissioner for that purpose. Such application shall contain or be 9 accompanied by such evidence of the age of the vessel described in the 10 application as may be required by the commissioner. For the purposes of 11 this section the designation of "historic" shall include boats built 12 prior to nineteen hundred nineteen, "antique" shall include boats built 13 between nineteen hundred nineteen and nineteen hundred forty-two, and 14 "classic" shall include boats built between nineteen hundred forty-three 15 and nineteen hundred sixty-eight. If an application for a historic, 16 antique or classic designation is approved, said vessel shall be issued 17 a registration number that includes the year of the boat and a desig- 18 nation sticker as prescribed by the commissioner. 19 § 2. This act shall take effect immediately.
