MARCHIONE -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the environmental conservation law, in relation to the powers and duties of the Historic Hudson-Hoosic Rivers Partnership THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Subdivisions 4 and 5 of section 42-0107 of the environ- 2 mental conservation law, as added by chapter 737 of the laws of 2006, 3 are amended to read as follows: 4 4. To appoint AND REMOVE an executive officer, officers, agents and 5 employees, and prescribe their duties and qualifications and fix their 6 compensation. 7 5. To contract for professional and technical assistance and advice, 8 INCLUDING RETAINING OR EMPLOYING COUNSEL, PRIVATE CONSULTANTS AND INDE- 9 PENDENT CONTRACTORS. 10 S 2. Subdivision 13 of section 42-0107 of the environmental conserva- 11 tion law is renumbered subdivision 15, and two new subdivisions 13 and 12 14 are added to read as follows: 13 13. TO ADOPT AND USE A SEAL. 14 14. TO CONSTRUCT OR CAUSE TO HAVE CONSTRUCTED NECESSARY FACILITIES, 15 INCLUDING PATHS AND TRAILS, A VISITOR EDUCATION CENTER, AND RELATED 16 PARKING AREAS ON THE LAND DESCRIBED IN SECTION THREE OF THE CHAPTER OF 17 THE LAWS OF TWO THOUSAND FIFTEEN THAT ADDED THIS SUBDIVISION. 18 S 3. The Historic Hudson-Hoosic Rivers Partnership, established pursu- 19 ant to article 42 of the environmental conservation law, is authorized 20 to acquire the following property: 21 VISITOR CENTER 22 BEGINNING at a point in the northerly bounds of New York State Route 23 29, said point being situate at a distance of 551.69 feet. Northwester- 24 ly, measured along said Route 29 from a concrete monument in the north 25 bounds of Route 29 at the southwest corner of a parcel of land reputedly EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD02572-08-5 S. 5948 2 1 owned by Lydia Grolley, and which said point of beginning is also situ- 2 ate at a distance of 26 feet, Northwesterly, from the northwesterly 3 corner of a sewage pump station, and which point of beginning is also 4 located at a distance of 12.05 feet, Northerly, of the northerly edge of 5 the 4 foot concrete gutter running along the northerly side of Route 29, 6 running thence from said point of beginning, North 57 degrees 00 minutes 7 20 seconds West, along the northerly bounds of Route 29, also known as 8 Ferry Street, for a distance of 187.0 feet to a point at the southwest 9 corner of the parcel herein described, and which said southwest corner 10 is situate at a distance of 104 feet, Easterly, from the southeast 11 corner of the existing town water building located at the northeast 12 corner of Canal Street and Ferry Street; thence the following five 13 courses and distances along the east bounds of the Old Champlain Barge 14 Canal, viz: North 18 degrees 09 minutes East, 62.24 feet; North 27 15 degrees 03 minutes East, 79.16 feet; North 34 degrees 40 minutes East, 16 65.05 feet; North 47 degrees 12 minutes 40 seconds East, 366.55 feet and 17 North 57 degrees 56 minutes 50 seconds East, 126.25 feet to the north- 18 west corner of the parcel herein described, said northwest corner being 19 25 feet, more or less, south of the center line of a 10 foot wide dirt 20 road leading from the east end of Saratoga Street, Easterly and Souther- 21 ly, through the village Park; thence South 51 degrees 14 minutes East 22 for a distance of 170.00 feet to the northeast corner of the parcel 23 herein described, and which said northeast corner is located 25 feet 24 Southerly of the center line of the above mentioned dirt road; thence 25 South 41 degrees 55 minutes 30 seconds West, through the lands of the 26 party of the first part hereto, for a distance of 664.67 feet to the 27 place of beginning and containing 3.33 acres of land, be the same more 28 or less. 29 SWORD SURRENDER SITE 30 ALL that certain piece or parcel of land situate and being in the Town 31 of Saratoga, County of Saratoga and State of New York, bounded and 32 described as follows: 33 BEGINNING at a capped iron rod, located at the intersection formed by 34 the westerly line of New York State Route 4 with the Southerly line of 35 Schuyler Street, thence in a southwesterly direction along the westerly 36 side of New York State Route 4, the following two courses: 1) South 11 37 15' 40" West, 72.13 feet to a concrete monument and 2) South 09 13' 11" 38 West, 119.26 feet to a point; thence in a westerly, southerly and east- 39 erly direction and along the lands now or formerly of William Hartloff 40 and Darlene Duggan (Liber 1651, Page 713) the following five courses: 41 1) North 78 32' 40" West, 87.90 feet to an iron rod; 2) South 14 22' 42 01" West, 101.37 feet to a capped iron rod; 3) South 78 32' 40" East, 43 60.72 feet to a point; 4) south 08 21' 53" West, 83.00 feet to an iron 44 rod and 5) South 78 32' 40" East, 33.17 feet to point; thence in a 45 southerly direction and along the aforesaid westerly line of the afore- 46 said N.Y.S. Route 4, the following 3 courses: 1) South 06 14' 15" 47 West, 298.50 feet to a point; 2) South 10 57' 43" West, 200.64 feet to 48 a concrete monument and 3) South 00 36' 17" East, 220.93 feet to a 49 capped iron rod; thence in a westerly and southerly direction and along 50 the lands now or formerly of Scott Goldup (Liber 1523, Page 332) the 51 following two courses: 1) North 67 34' 16" West, 294.46 feet to a 52 capped iron rod and 2) South 21 10' 25" West, 317.81 feet to corner 53 fence post; thence in a westerly direction and along the northerly line 54 of said Helen Hoffman (Book 788, Page 359), the following five courses: 55 1) North 74 31' 09" West, 169.80 feet to a point; 2) North 72 51' 56" 56 West, 201.40 feet to a point; 3) North 75 27' 24" West 97.48 feet to a S. 5948 3 1 point; 4) North 71 58' 27" West 142.11 feet to a point and 5) North 79 2 38' 45" West, 77.86 to a capped iron rod; thence in a northerly direc- 3 tion along the lands of said Shostak (Book 973, Page 504 and Lois DeChi- 4 ro (Liber 1307, Page 352), North 20 17' 23" East 742.91 feet to a 5 capped iron rod; thence in an easterly direction and along the lands of 6 said Dennison (Book 735, Page 357) and William and Catherine Ippoliti 7 (Liber 1500, Page 366), South 74 49' 00" East, 460.19' to an iron rod; 8 thence in a northerly direction and along the easterly line of the afor- 9 esaid lands of Ippoliti, North 14 34' 00" East, 606.00 feet to a capped 10 iron rod located in the aforesaid southerly line of Schuyler Street; 11 thence in an easterly direction along said southerly line of Schuyler 12 Road, the following four courses and distances: 1) South 76 13' 21" 13 East, 95.70 feet to a point; 2) South 76 04' 26" East 71.52 feet to a 14 point; 3) South 76 41' 27" East 100.52 feet to a point and 4) South 75 15 58' 52" East, 70.02 feet to the point or place of beginning. 16 Containing in all 18.894 acres of land being more or less. 17 S 4. This act shall take effect immediately.
