        AN ACT in relation to authorizing the town of Rush, county of Monroe, to
          use certain property for recreational and educational purposes as well
          as to lease such property for authorized purposes
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1. Notwithstanding any other provision  of  law  and  notwith-
     2  standing  the  provisions  of a deed dated January 12, 2010 and filed in
     3  the Monroe county clerk's office in Book 10869 page 606 to the contrary,
     4  the town of Rush, county of Monroe, shall be authorized and empowered to
     5  use the land described in section two of this act  to  host  the  Monroe
     6  County  Fair,  for  the  production and collection of timber and for all
     7  other agricultural, recreational and educational purposes and  shall  be
     8  authorized  and  empowered to lease the land described in section two of
     9  this act for such consideration and  upon  such  terms,  conditions  and
    10  provisions  as  shall  be  mutually agreed upon between the town and the
    11  lessee for all such authorized purposes.
    12    § 2. The lands referenced to in section one of this act shall  consist
    13  of  ALL THAT PIECE or parcel of land situate in the Town of Rush, County
    14  of Monroe, State of New York, being a portion of Lot Numbers 57  and  58
    15  in  Township Number 11, Range 7 of the Phelps and Gorham Purchase, being
    16  bounded and described as follows:

     1    Beginning at an iron rod in the northerly bounds of  the  Scottsville-
     2  Rush  Road (N.Y.S. Route 251) at its intersection with the division line
     3  between the lands, now or formerly, of the National  Railway  Historical
     4  Society,  Rochester Chapter, on the east, and the lands of the people of
     5  the state of New York, on the west; thence along the northerly bounds of
     6  the   Scottsville-Rush   Road,  the  following  three  (3)  courses  and
     7  distances:
     8    1. N. 79° 15' 15" W., a distance of 2,089.79 feet to a point of curva-
     9  ture;
    10    2. along a curve to the right having a radius of 2,038.24 feet, for an
    11  arc length of 276.75 feet to the point of tangency; and
    12    3. N. 71° 28' 28" W., a distance of 45 feet, more or less, to a  point
    13  on  the  easterly bank of the Genesee River; thence northerly, along the
    14  easterly bank of the Genesee River, the following nine (9)  courses  and
    15  distances:
    16    1. N. 47° 23' 07" E., a distance of 497.49 feet to a point;
    17    2. N. 55° 55' 04" E., a distance of 418.53 feet to a point;
    18    3. N. 61° 01' 06" E., a distance of 1,224.56 feet to a point;
    19    4. N. 37° 29' 29" E., a distance of 415.29 feet to a point;
    20    5. N. 21° 16' 13" E., a distance of 106.37 feet to a point;
    21    6. N. 00° 23' 19" W., a distance of 402.47 feet to a point;
    22    7. N. 11° 06' 23" W., a distance of 860.06 feet to a point;
    23    8. N. 21° 48' 10" W., a distance of 415.82 feet to a point; and
    24    9.  N.  32°  16'  17"  W., a distance of 453.43 feet to a point on the
    25  division line between the Town of Henrietta, on the north, and the  Town
    26  of  Rush, on the south; thence N. 88°33'32" E., along the last mentioned
    27  division line, and passing through an iron rod  at  66.23  feet,  for  a
    28  total  distance  of  1,088  feet,  more  or  less, to an iron rod in the
    29  westerly bounds of lands, now or formerly, of Consolidated  Rail  Corpo-
    30  ration;  thence  southerly  along  the  westerly bounds of said railroad
    31  lands to and along said lands of the National Railway Historical Society
    32  the following eight (8) courses and distances:
    33    1. S. 07° 00' 18" W., a distance of 1,884.87 feet to a point;
    34    2. S. 06° 07' 48" W., a distance of 1,080.62 feet to a point;
    35    3. S. 05° 50' 34" W., a distance of 406.73 feet to a point;
    36    4. S. 07° 00' 18" W., a distance of 494.28 feet to a point;
    37    5. S. 10° 08' 00" W., a distance of 225.20 feet to a point;
    38    6. N. 88° 33' 32" E., a distance of 16.59 feet to a point;
    39    7. S. 07° 00' 18" W., a distance of 509.61 feet to a point; and
    40    8. S. 07° 37' 47" W., a distance of 472.26 feet to the point or  place
    41  of beginning, containing 100.548 acres of land, more or less.
    42    §  3.  The commissioner of general services shall file an amended deed
    43  with the County of Monroe, for the property described in section two  of
    44  this  act,  to  reflect  the  use  of  such  property for all authorized
    45  purposes described in section one of this act.
    46    § 4. This act shall take effect immediately.
